Background: Located inthe Specialty Retail "SR",Hometown District Overlay "HD-OV,"theapplicant is proposing toopentwo (2)new general restaurant useswithinthe existing building (Commercial Space-101 and Commercial Space-102).Each commercial space shall have aseparate business licenseand parking requirements.Thisreport identifies the requirements neededfor Commercial Space 102. Each ofthe general restaurants will operate independently ofeachotherand will front SW 71st Street.The applicant has applied for a special exception waiving strict compliance to the parking requirements and payment into the Hometown Parking Fund for business locatedwithintheHometownOverlay District. Figure1:ProposedFloorPlan When reviewing the project,the following items are noted: •The site is currently being operated bya dry cleaner and has a total square footage of 5,357 square feet Commercial Space -102 will occupy 2,756 square feet ofthe building. •The existing building abuts similar restaurant uses tothe north (Akashi and Rice: House of Kabob)as well as tothe south (Old Lisbon,Station 5,and Temple). •The site currently has a total of ten (10)on-site parking spaces. As shown on the attached site plan,the applicant is proposing a complete renovation of the site that includes the installation ofa new refuse enclosure,new outdoor patio area, and new landscape areas.By creating these new areas 2 parking spaces will be eliminated from the code required refuse enclosure and 2 additional parking spaces will be eliminated from the installation ofthe patio and landscaping area,leaving six (6)on-site parking spaces for use that will be divided equally between Commercial Space 101 and 102.As a result Commercial Space 102 is required to provide a total of twenty (20) parking spaces,but with a credit for 3 existing parking spaces the modified requirement for provided parking spaces is 17. Thedeveloperatthistimeis seeking Special Exception approval from theCity Commission toreducetheamountof required parking from 17 to0,andfeewaiver for the $17,000 intotheHometownImprovement Trust Fund. Pursuant to Section 20-7.51 (A)ofthe LDC,thecity commission may,by special exception,waive strict compliance withthe provisions ofthe Hometown District Overlay Ordinance.In granting a special exception,thecity commission must find by substantial competent evidence that: 1.The proposed development contributes to,promotes and encourages the improvement ofthe Hometown District and catalyzes other development as envisionedintheHometown District regulations. The addition ofthenew restaurant uses would encourage more patrons to visit the Hometown District whichwouldin turn further stimulate the growth ofthe Hometown District from adevelopment standpoint. 2.The proposed development is compatible with the land uses and development intensities prescribed by all applicable city regulations. Surrounded by restaurant uses,the proposed project would be compatible with the surrounding land uses and development intensities prescribed. 3.The proposed development must possess integrity of design compatible with the design criteria established for the Hometown District andwiththe overall image of thecity. The proposed restaurant possesses integrity of design thatis compatible withthe design criteria established for the Hometown District.Furthermore,its design is keepingwiththe overall imageofthecity. 4.The proposed development shall be designed in a manner that provides for effective management of traffic (vehicular and pedestrian),parking,lighting,noiseandwaste generated bythe development,and management ofthe impacts ofthedevelopment onpublic facilities and services. Utilizing an existing one (1)story building,the proposed project willbesetback approximately forty-six (46)feet from SW 71st Street,whichwillallow for the incorporation ofsix (6)on-site parking spacesaswellasan outdoor seating area that willbe located within private property;that will allow for an effective management of traffic.As part ofthe project,anew refuse enclosure is being proposed along the eastern perimeter ofthe property that will be enclosed in order toaccommodatethe waste generated bythe development. 5.The proposed development does not expand the permitted uses within the Hometown District. The proposed project willnot expand the permitted useswithintheHometown District.The proposal oftwo (2)new restaurants willbe contained within the existingone (1)story building,whichwillbe renovated.It is important tonote thatwhilethe building willbe renovated in order to accommodate thenew restaurants,no additional square footage willbeaddedtothespace.Furthermore, the impervious surface for thesitewillbe reduced in order to incorporate landscaped areas atthe front ofthe site. 6.The proposed development will not have an unfavorable effect onthe economy ofthe City ofSouth Miami. The proposed restaurant uses will not have an unfavorable effect onthe economy of the City of South Miami.In fact it will contribute by continuing the occupation of an existing one-story building that will addtothedowntown attraction for residents and visitors. 7.The proposed development,when considered cumulatively with other development,both present and future,within the Hometown District,will not create excessive overcrowding or concentration ofpeopleor population. The proposed restaurant uses,when considered cumulatively with other development,both present and future,within the Hometown District is determined tobeofa compatible and complementary nature with the existing and future planned surrounding uses. It is important tonote that the Hometown District urban design features provide for connectivity to alternative modesof transportation via mass transit,bicycles and pedestrian corridors;although the proposed restaurant uses by code will still generate the need for additional dedicated parking spaces as some visitors will arrive via automobile, there are nearby parking facilities that can accommodate the influx ofnew patrons tothe Hometown District.
