Each ofthe general restaurants will operate independently ofeachotherand will front SW 71st StreetTheapplicanthas applied fora special exception waiving strict complianceto the parking requirements andpaymentintothe Hometown Parking Fund forbusiness located within the Hometown Overlay District. Site Loqqtiorv. Analysis: As shownin Figure 1,the existing one-story building will be divided intotwo (2) restaurant spaces. Figure1:Proposed FloorPlan When reviewing the project,the following items are noted: •The site is currently being operated by a dry cleaner and has a total square footage of5,357 square feet.Commercial Space -101 will occupy 2,601 square feet ofthe building. •The existing building abuts similar restaurant uses tothe north (Akashi and Rice: House of Kabob)as well astothe south (Old Lisbon,Station 5,and Temple). •Thesite currently hasa total often (10)on-site parking spaces. •The Floor Plan/Site Plan showsthatthe proposed Restaurant Space 101 will utilize 2,601squarefeet. As shown onthe attached site plan,the applicant is proposing a complete renovation of thesitethat includes the installation ofanew refuse enclosure,new outdoor patio area, andnew landscape areas.By creating these new areas 2 parking spaces will be eliminated from thecode required refuse enclosure and2 additional parking spaces will be eliminated from the installation of the patio and landscaping area,leaving six (6)on-site parking spaces for use that will be divided equally between Commercial Space 101 and 102.As a result Commercial Space 101 is required to provide a total of twenty (20) parking spaces,but with a credit for 3 existing parking spaces the modified requirement for provided parking spaces is 17. USE TYPE 1 parking spaceper RESTAURANT,GENERAL OR WALK UP 100 SF for patron use 300 SF for non-patron use As listed in Section 20-7.6(C)(2)(b)ofthe LDC,if there are fewer spaces provided than required for existing buildings,the applicant may:obtain a special exception waiving the number of additional parking spaces required;or pay into the Hometown District Improvement Trust Fund theamountof$17,000 annually witha5%increase also annually. The developer at this time is seeking Special Exception approval from the City Commission to reduce theamountof required parking from 17 to0,and fee waiver for the $17,000 intotheHometown Improvement Trust Fund, Pursuant to Section 20-7.51 (A)ofthe LDC,thecitycommissionmay,by special exception,waive strict compliancewiththe provisions oftheHometown District Overlay Ordinance.In granting aspecialexception,thecitycommissionmustfindby substantial competent evidence that: 1.The proposed development contributes to,promotes and encourages the improvementofthe Hometown District andcatalyzesotherdevelopmentas envisionedintheHometown District regulations. The addition ofthenew restaurant useswould encourage more patrons tovisitthe Hometown District whichwouldinturn further stimulate the growth ofthe Hometown District from adevelopment standpoint. 2.The proposed developmentiscompatiblewiththe land usesanddevelopment intensities prescribed by all applicablecity regulations. Surrounded by restaurant uses,the proposed project would be compatible with the surrounding landusesanddevelopment intensities prescribed. 3.The proposed developmentmust possess integrity of design compatiblewiththe design criteria established for theHometown District andwiththe overall imageof thecity. The proposed restaurant possesses integrity of design that is compatible withthe design criteria established for the Hometown District.Furthermore,its design is keepingwiththe overall image ofthe city. 4.The proposed development shall be designed in a manner that provides for effective management of traffic (vehicular and pedestrian),parking,lighting,noise andwaste generated bythe development,and management ofthe impacts ofthe development on public facilities and services. Utilizing an existing one (1)story building,the proposed project will beset back approximately forty-six (46)feet from SW 715l Street,which will allow for the incorporation ofsix (6)on-site parking spaces aswellasan outdoor seating area that willbe located within private property;that will allow for aneffectivemanagement of traffic.As part ofthe project,anew refuse enclosure isbeing proposed alongthe eastern perimeter ofthe property that will beenclosedin order toaccommodatethe waste generated bythedevelopment. 5.The proposed developmentdoesnot expand the permitted useswithinthe Hometown District. The proposed project will notexpandthe permitted useswithintheHometown DistrictThe proposal oftwo (2)new restaurants will becontainedwithinthe existingone (1)story building,whichwillbe renovated.It is important tonote thatwhilethe building will be renovated in order toaccommodatethenew restaurants,no additional square footage will beaddedtothe space.Furthermore, the impervious surface for thesite will be reduced inorderto incorporate landscaped areas atthe front ofthesite. 6.The proposed development will not have an unfavorable effectontheeconomy oftheCityof South Miami. The proposed restaurant uses will not have an unfavorable effect onthe economy of the City of South Miami.In fact it will contribute by continuing the occupation of an existing one-story buildingthatwilladdtothedowntown attraction for residents and visitors. 7.The proposed development,when considered cumulatively withother development,both present and future,withintheHometown District,will not create excessive overcrowding or concentration ofpeopleor population. The proposed restaurant uses,when considered cumulatively with other development,both present and future,within the Hometown District is determined tobeofa compatible and complementary nature withthe existing and future planned surrounding uses. It isimportanttonotethattheHometown District urban design features provide for connectivityto alternative modesof transportation viamass transit,bicyclesand pedestrian corridors;although the proposed restaurant uses bycode will still generate the need for additional dedicated parking spacesassome visitors will arrive via automobile, there are nearby parking facilities that can accommodate the influx of new patrons to the Hometown District. Planning Board Recommendation: At the September 8,2015 public hearing the Planning Board recommended approval of the Special Exception withavoteof3to2. TheApplicant'sproposed development is illustrated onthe attached plans,does notincreasethesquarefootageoftheexisting building,offerscompatibleand complimentary uses that will operate harmoniously withtheotherretail uses that operateinthe vicinity,and will notoverburdenroadwaysorotherCityservices.The outdoor seating fortheApplicant'sproposed development wouldnot be inthe public- right-of-way.
