Subject Building located at 5801 Sunset Drive Analysis: Pursuant to the Special Use Conditions,Section 20-3.4 of the LDC,a special use may be approved and permitted by the city commission atapublichearing,after a recommendation by the planningboardand that suchuse complies with the general requirements,special requirements,andany other conditions that the citycommissionmayconsider appropriate and necessary. When reviewing the project,the following items are noted about the project: •The existing one-story buildingisnearsimilar restaurant uses to the north(Akashiand Rice:House of Kabob),to the south (Sushi Maki andStarbucks),and to the east (Mellow Mushroom). •The tenant spacehasa total squarefootage of approximately2,070squarefeet. •The Patron Areahasatotalsquarefootageofapproximately1,170squarefeet. •The Non-Patron areahasa total squarefootageof approximately 900squarefeet. Asshownon the attachedsite plan,the applicant is proposing acomplete renovation of the space.Pursuant to Section 20-7.12(A)of the LDC,the parkingconditionforageneral restaurant is as follows: •100 SFdevoted to patron use •300 SF devoted to non-patronuse Basedon the informationprovided,the proposed general restaurant will berequiredtoprovide aminimumoffifteen (15)parking spaces.Thereisanoff-street parking spacecreditofseven (7) parking spaces. Oncethecredithasbeen applied,the proposed general restaurant will havea parking space deficitofeight (8)parking spaces.The applicant isnotrequestinga special exceptionwavier for their parking requirements.The applicant agrees topay$8,000 annually intothe Hometown District ImprovementTrust Fund;which is based uponthe $1,000 per parking spacefee for businesses that don't meet the parkingrequirementswithin the SR-HDOV. Afterreviewofthe project,the proposed general restaurant usecomplieswithboththe general and special requirements listed inboth Section 20-3.4(A)and Section 20-3.4(B)(4)(B)of the LDC,respectively,in that the use: •Complies withallrequirementsestablishedinthe SR-HDOV zoning district; •Iscompatibleand complementary to the existinguseswithin the surrounding areas;and •Is not proposing any outdoor seating at this time.
