BACKGROUND: Agenda Item NO.:~ ., Land Development Code, Article V a scrivener's error referring to the The proposed Ordinance amends the Land Development Code, Article V Section 20- 5.8(A) -Special Use Approvals. The error identified requires a change from the current language stating an incorrect citation. Currently the law states that a Special Use may be granted for any land use indicated in the Permitted Use Schedule of Section 20-3.4(E). It shall be revised to the correct Section 20-3.30. STAFF RECOMMENDATION: Staff recommends Commission approval of the ordinance to correct the scrivener's error. WHEREAS, a scrivener's error has been found in the Land Development Code in its reference to the Schedule of Uses, which error is corrected via this amendment; and WHEREAS, the City Commission desire to implement the above through the adoption of this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. South Miami Land Development Code Article V, "Procedures and Applications," Section 20-5.8, "Special use approvals," is hereby amended to read as follows: 20-5.8 -Special use approvals. (A) Use Schedule Reference. A special use may be granted for any use indicated in the Permitted Use Schedule (Section 29 3AB 20-3.3(l))) with an "S" designation in the appropriate district column. * * * Section 2. Codification. The provisions of this ordinance shall become and be made part of the Land Development Code of the City of South Miami as amended. Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance or the Guidelines adopted hereunder. Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 5.
