3 An Ordinance relating to the year 2016 General and Special Election of the
4 Mayor and City Commissioners for Groups, II and III; scheduling the day,
5 place and time of the election; ~cheduling the day, place and time of early
6 voting; providing for qualification of candidates; providing for close of
7 election books; approving the official ballot; providing for notification.

9 WHEREAS, Article V, Section 2A, of the City of South Miami Charter provides
10 that the City Commission of the City of South Miami shall schedule a general election for
11 February of each even year, and that the Mayor shall be elected for a term of two (2)
12 years and commissioners shall be elected for terms of four (4) years at the general
13 election; and

15 WHEREAS, Article V, Section 2D, of the City of South Miami Charter provides
16 that no person may appear on the Ballot for Election as Mayor or City Commissioner if,
17 by the end of his or her current term of office, the person will have served (or, but for
18 resignation would have served) in office as the Mayor or as a City Commissioner for a
19 total of nine years or more; and

21 WHEREAS, the Charter requires the City Commission of the City of South Miami
22 to schedule the day, place and time of the general election by ordinance; and
23
24 WHEREAS, state law requires election books to close twenty-nine (29) days prior
25 to the election.

27 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
28 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

30 Section 1. The 2016 General and Special Election will be held on Tuesday,
31 February 9, 2016. On that date, a mayor will be elected to serve a term of two (2) years,
32 and two (2) Commissioners, one from Group II and one from Group III, will be elected to
33 serve a term of four (4) years. Early voting shall occur on Saturday, Februarv 6, 2016,
34 from 9:00 a.m. through 5:00 p.m.
35 Section 2. The qualifying period for this election shall open Monday,
36 NO'fembsr 30, Wednesday, December 2,2015 at 9:00 a.m. and close Friday, Deeember 4,
37 Tuesday, December 8,2015, precisely at 5:00 p.m. Candidates shall qualify at the office
38 ofthe City Clerk, 6130 Sunset Drive, South Miami, Florida.

40 Section 3. Voting shall be conducted at City Hall in the City Commission
41 Chamber, 6130 Sunset Drive, South Miami, Florida. The polls shall open precisely at
42 7:00 a.m. and close precisely at 7:00 p.m.

Section 4. The sample ballot for the 2016 general and special election IS
annexed to this ordinance.
Section 5. The election books shall close Monday, January 11,2016.
Section 6. The City Clerk shall publish notice of such general and special
election once a week for four consecutive weeks next preceding the general and special
election in a newspaper of general circulation in South Miami. The notice shall contain
the date, time, and place of the general and special election and identify the Commission
Groups.
Section 7. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 8. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are repealed.
Section 9. This ordinance shall take effect immediately upon enactment.

Miami-Dade County election officials shall conduct the Run-off Election hereby called, with acceptance of the cartification of tha results of
the election to be performed by the City Commission. The official returns for each precinct shall be furnished to the City Clerk of the City of
Miami Beach as soon as the ballots from all preCincts have been tabulated.
Tha voting precincts in the City for the Run-Off Eleatlon shall be as established by the Miami-Dade County election officials. On Election Day,
all electors shall vote at the voting location and the voting precincts in which the official registration books show that the electors reside.
All questions conceming voting location and voting precincts should be directed to the Miami-Dade County Electiofls Department,

Registration of persons desiring to vote in \he Run-Off Election shall be in accordance with the gonerallaw ofthe State of Florida governing
voter registration. Qualified persons may obtain registration forms to vota at the Offi~ of the City Clerk, CIty Hall, 1700 Convention Center
Drive, First Floor, Miami Beach, Florida, 33139, during normal business hours, and at such other voter registration centers and during such
times as may be provided by the Supervisor of Elections of Miami-Dade County. The voter registration deadline for the RUn·off Election
was Monday, October 19, 2015. All persons eligible to vote at the Elections must be registered before the date set forth herein or have
registered previously, as provided by law. Each person desirlng to become a registered voter shall be responsible for properly filling out
the reg·lstratien form Bnd returning It to the Miami-Dade County Elections Department. All questions concerning voter registration should

Absentee voters participating in the Run-Off Election shall be entitled to cast their ballots in acoordanoo with the provisions of the Laws
