BACKGROUND: The applicant is requesting approval to construct a 5 story "large scale development" on property in the TODD MU-5 zoning district. The site is 40,998 square feet (0.94 acres) and is legally described in the property survey, attached. The proposed development consists of a five story mixed use (retail/office/medical office) building with a parking garage in the rear. The building will contain a total of 65,739 square feet; with 14,252 square feet of retail space, 10,747 square feet of office space and 40,740 square feet of medical office space. The special exception section in the TODD regulations (Sec.20-8.9) requires that any new development built in the zoning district that exceeds 40,000 square feet or exceeds four (4) stories must be reviewed by the Planning Board and approved by the City Commission using the special exception approval process. SITE LOCATION ApPLICABLE REGULATIONS • LDC Section 20-8.9 Special Exceptions, Large Scale Development • LDC Section 20-8.10 Bonus Allocations ANALYSIS: Located at the North West corner of SW 72 Street (Sunset Drive) and SW 62 Avenue within the TODD MU-5 zoning district, the development plan shows a five story commercial building with a pedestrian arcade and a parking garage in the rear. The building's side exterior will look similar to the front exterior on adjacent facing streets. The frontage fac;ade will be along SW 72 Street (Sunset Drive). The proposed development is being built to the front property line, which is allowed. The proposed building provides a 20 foot front setback at the 5th floor as required by TODD regulations. The rear of the building provides a 5 foot setback, which is allowed based on the fact that the parking garage is located behind the building. The maximum height of a building in the TODD (MU-5) zoning district is four stories. If certain design elements are incorporated a developer may build up to four additional floors. The proposed development has added one additional floor based upon the bonus design provision of full frontage with street design; which is part of the pedestrian walkway system. This added feature allows the building to be designed as a five story structure with a maximum floor height of 14 feet per floor. The building complies with the maximum building height allowed in the TODD (MU-5) zoning district of 100 feet. The applicant has also redesigned the loading area by request of the City engineer to provide a half circular drive way to allow for an interior delivery entrance and exit on the ground floor along SW 62 nd Avenue. The development of this structure will be compatible and complementary in nature with existing or planned surrounding uses along SW 72 Street (Sunset Drive). Furthermore, pursuant to the attached documentation from Miami-Dade County and Florida Department of Environmental Protection, the subject property was successfully released from any future obligation to rehabilitate the site. PLANNING BOARD ACTION: At the August 11,2015 Planning Board meeting and following a public hearing, the Board voted 6-0 for approval forwarding of the special exception application PB-15-012 to the commissioners with the following conditions: • Sidewalk pattern should continue uninterrupted along 62 nd Avenue • Reduce driveway exit of loading area on 62 nd Avenue to 15 feet STAFF RECOMMENDATION Staff recommends approval for the Special Exception application to construct as-story building at 6201 Sunset Drive with the Planning Board conditions that are listed above. Remedial measures may include, but are not limited to: 33 1. Additional screening or buffering; 34 ii. Additional landscaping; 35 iii. Building orientation; 36 iv. Relocation of proposed open space, or alteration of the use of such 37 space; 38 v. Pedestrian and bicycle safety and access; 39 VI. Changes to ingress and egress; 40 vii. Addressing traffic flow to and fi'om the development to avoid 41 intrusion on local streets in nearby single family residential areas; or 42 viii. Improvement of the streets adjacent to the project, if applicable. 43 44 WHEREAS, Section 20-8.9 (D) requires that: 1 2 3 4 5 6 7 8 9 10 11 (a) Prior to approving a Large Scale Development the City Commission must find that the development meets the requirements set forth in subsection (C) above and that it: 1. Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; 2. Will not be detrimental to the public welfare, property or improvements in the neighborhood; and 3. Complies with all other applicable Code provisions. (b) Additional Conditions. The City Commission may designate such additional requirements in connection with the approval of a Large Scale Development as will, in its opinion; assure that such development will conform to the foregoing requirements 12 WHEREAS, the City'S Planning Director has detennined that the developer has met all 13 of the requirements set forth in the City's Land Development Code, other than Commission 14 approval and the Developer has agreed to provide full frontage building with street design as 15 part of pedestrian walkway system to receive a bonus of one additional floor; and 16 17 WHEREAS, the approval of a special exception requires a recommendation from the 18 Planning Board and the approval of the City Commission after a public hearing; and 19 20 WHEREAS, the Planning Board, at its August 11,2015 meeting, voted 6 ayes, 0 nays to 21 recommended approval of the request for a special exception to build a 5 story structure with 22 conditions. 23 24 WHEREAS, the City Commission desires to accept the recommendation of the Planning 25 Board. 26 27 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 28 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 29 30 Section 1: The Special Exception Application submitted by the applicant to construct a 31 for 5 story "large scale development" advances the economic development of the City, is 32 compatible with land use, density, and design criteria established for the TODD MU-5 zoning 33 district and is hereby approved subject to the following teons and conditions as well as all 34 applicable City ordinances, codes, rules and regulations: 35 36 37 38 39 40 41 42 43 44 (A) Planning Board conditions. (I) Reduce loading area driveway exit curb cut for delivery trucks to 15 feet along 62 nd A venue, and incorporate all driveways design to provide for better pedestrian crossing along 62 nd Avenue and Sunset Drive. (2) Maintain continuous sidewalk along 62 nd Avenue and Sunset Drive for pedestrian movement, and remove curb cuts from prior gas station along the property front and sides. 1 Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for 2 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall 3 not affect the validity of the remaining portions of this resolution. 4 5 Section 3. Effective Date. All such uses shall comply with all requirements established in the appropriate zoning use district, unless additional or more restrictive requirements are set forth belovv or by the City Commission, 2. All such uses must be of a compatible and complementary nature with any existing or planned surrounding uses. 3. The City Commission shall determine the overall compatibility of the development with the existing or planned surround'lng uses. 4. If during the review process it is determined that the development, as proposed, will potentially cause adverse impact, the Planning Department shall recommend remedial measures to eliminate or reduce, to the extent possible, these impacts. Development projects that are recommended for remedial measures will not be required to subm"t a new application unless it is determined by the Department that additional changes which would have the effect of increasing densities, square footage or altering the height or use of a Development have been made. Remedial measures may include, but are not limited to: i. Additional screening or buffering; ii. Additional landscaping; iii. Building orientation; iv, Relocation of proposed open space, or alteration of the use of such space; iv. Pedestrian and bicycle safety and access; v. Changes to ingress and egress; vi. Improvement of the streets adjacent to the project, if applicable. (D) Project Approval: a. Required Conditions: Prior to approving a Large Scale Development the City Commission must find that the development meets the requirements set forth in subsection (e) above and that it: 1. Will not adversely affectthe health or safety of persons residing or working in the vicinity of the proposed use; 2. Will not be detrimental to the public welfare, property or improvements in the neighborhood; and 3. Complies with all other applicable Code provisions. b. Additional Conditions: The City Commission may designate such additional requirements in connection with the approval of a Large Scale Development as will, in its opinion, assure that such development will conform to the foregoing requirements. (I) The granting of a special exception shall be conditioned on the Applicant signing an agreement with the City, in a form acceptable to the City, which shall include all of the conditions required for the granting of the special exception ("Development Agreement"). The Development Agreement, after it has been drafted by the City Attorney shall be subject to approval by the City Commission. A separate agreement or covenant ("Covenant") that provides for maintenance of common elements and any other condition specified as a prerequisite to approval of the special exception ("Maintenance Cove nants") shall be signed by the owner of the property in question. The Maintenance Covenant shall be treated as a covenant running with and binding the land upon which the Development is situated and it shall be recorded in the land records of Miami-Dade County and, at the option of the City and if allowed by law, the Maintenance Covenant may be re-recorded when necessary or required to maintain, uninterrupted, the effectiveness of the covenant' running with the land. The Covenant shall provide that the owner and his/her/its grantees, heirs, successors and assigns ("Owner") shall comply with the Maintenance Covenants at the Owner's expense and without any cost to the City, (1) In the event that any special exception condition includes the development of any common areas ("Common Areas"), the Maintenance Covenant shall include the following provisions: (a) the Common Areas shall continue in existence, as part of the structure and those Common Areas shall be operated and maintained at the expense of the Owner of the property so long as the Development continues to exist, in whole or in part; (b) the operation and maintenance of the Common Areas shall include a provision for landscaping in accordance with an approved site and development plan, approved by the City Commission and the Environmental Review and Preservation Board, or as amended from t'lme to time with approval of the City Commission, the maintenance of the landscape as well as other maintenance services and private security protection of the Common Areas; (c) the Owner shall continue, operate and maintain the Common Areas in such a manner as to keep such areas in good order, clean, attractive, fully functional (subject to interruption for maintenance, repair, restoration and renovation) and, generally, so as not to create a nuisance to owners, occupants and users of the adjacent land and surrounding areas and to the general public. (2) The Maintenance Covenant shall define the phrase "continue, operate and maintain", as it applies to landscaping, to include, but not limit it to, the following activities: (al The monitoring of the landscape areas by a recognized landscape expert, acceptable to the City, and the preparation of reports by such expert certifying that the landscaping is in compliance or is not in compliance with the approved Landscape Plan and all provisions included in such plan pertaining to pruning, fertilizing and general maintenance; the reports shall be prepared annually; and (b) The replacing of plants, trees, shrubs or the like, at the Owner's sale expense, as determined by the landscape expert to be necessary in order for the landscaping to perpetually be in compliance with the Landscape plan. (c) In the event that the City disagrees with the opinion of the landscape expert hired by the Owner, the City shall have the right to hire its own landscape expert whose decision shall be final. If theCity's expert agrees with the eXpert hired by the Owner, the City shall pay the cost of its own expert, otherwise, the Owner shall pay the cost ofthe City's expert. (3) The Development Agreement and the Maintenance Covenant shall contain the following provision: (a) In the event the Owner breaches its agreement ("a Default") and fails to cure the default within thirty (30) days ("the Cure Period") after receiving written notice of the default or fails to use all due diligence in commencing the cure and in proceeding to effectuate the cure. If the Owner is unable to timely cure the default after receiving written notice, the Owner may request an extension of time from the City Commission which shall be granted ("Extended Cure Period") upon presentation of substantial competent evidence establishing the Owner's good faith and due diligence, justifiable reasons for the delay and the amount of time needed to cure the default. In the event that the Owner fails to cure the default within the Cure Period, or within the Extended Cure Period, whichever is greater, a fine shall be assessed against the owner 'In the amount of one hundred fifty dollars ($150.00), or such amount as may be set forth in the City Fee Schedule, for each day the owner remains in default thereafter. (bl In the event that a fine is assessed against the Owner, or the City incurs any expense towards curing the default, the City shall have the right to file a lien, or a continuing special assessment lien, as may be applicable, against the property and file ar,en foreclose action for the full amount of money incurred by the City for said expense as well as for any fine that has been assessed. The City's lien shall be perfected upon being recorded in the land records in Miami-Dade County, Florida and shall be of equal rank and dignity as the lien of City's ad valorem taxes and superior in rank and dignity to all other liens, encumbrances, titles and claims in, to, or against the land in question, unless in conflict with state statutes or Miami·Dade County code. (c) The City shall have the right to proceed against the Owner to collect the above- described costs and expenses without resorting to a lien and/or lien foreclosure. The City's remedies shall include all those available in law or in equity, including injunctive relief. The exercise of one available remedy shall not be deemed a waiver of any other available remedy. (d) Invalidation of any of the covenants Identifiedm this section 20-8.9, by judgment of court shall not affect any of the other provisions, which shall remain in full force and effect. In the event of a violation of the Development Agreement or the Maintenance Covenant, in addir,on to any other remedies available, the City of South Miami is hereby authorized to withhold any future permits, and refuse to make any inspections or grant any approval, until such time as the declaration of restrictive covenants in lieu of unity of title are complied with. You have requested that DPA analyze the vehicular trip generation from your proposed plan versus an "as-of-right" plan. Further, you asked us to research the traffic calming study for the CocoPlum Terrace area (March 2014) prepared for the city of South Miami. Lastly, you requested an evaluation of the proposed access plan for the project. The property at 6201 Sunset Drive in South Miami, FL is currently a vacant parcel of land previously occupied by a gas station. Exhibit 1 summarizes the proposed development program as well as an as-of- right plan. Exhibit 1 -As-of-Right and Proposed Land Uses Notes: SF GFA: Square Feet of Gross Floor Area SF GLA: Square Feet of Gross Leasable Area A trip generation analysis was prepared based on rates and/or equations from the Institute of Transportation Engineers (ITE) Trip Generation, 9th Edition. Exhibit 2 -ITE Trip Generation Summary . '. Compllrison of Scennrio AS-of-Right Plan Proposed Pilln -. Vehicular Impllcts The results of the trip generation analysis show a decrease in vehicular traffic for daily and PM peak hour conditions when comparing the proposed plan to the as-of-right plan. There is an increase in vehicular trip generation in the AM peak hour, when comparing the proposed plan to the as-of-right plan, but it is a minimal amount (approximately one vehicle every four minutes). Generally, the proposed plan and the as-of-right plan will have very similar traffic impacts. DPA also reviewed the Traffic Calming Study for the CocoPlum Tcrrace Area (March 2014). A summary of the critical information from the study is summarized below: I. The purpose of the study was to evaluate the existing traffic and operational conditions ofthe area. 2. Additionally, the data collected from a previous study (200 I) were compared to the existing conditions. 3. The analysis revealed the traffic calming measures implemented from the 2001 study have improved safety, improved traffic operations, reduced speeding, and reduced cut-thru traffic in the CocoPlum Terrace area. 4. The implementation of a southbound right tum lane on SW 62 Avenue at Sunset Drive was evaluated. The operational analyses concluded the benefits were minimal. The study did not recommend moving forward with this improvement. 5. The city should consider replacing stop signs with yield signs at all traffic circles. 6. The city should extend the eastbound left-tum restrictions on Sunset Drive between SW 64 Court and SW 62 Avenue to the afternoon hours (4-6PM). The city should consider modify the taper length of the eastbound left turn lanes on Sunset Drive at SW 62 Avenue to a typical lOO-foot length (Note: this will allow 4-5 more vehicles into the eastbound left turn lanes without spillback to Sunset Drive). 8. The city should coordinate with Miami-Dade Traffic Signals & Signs Division for traffic signal timing optimization at Sunset Drive / SW 62 Avenue and Sunset Drive / US-l in order to improve progression along Sunset Drive, which will reduce unnecessary delays. The traffic study was thorough and done using professional methodologies. The conclusions on implementation of traffic mitigation measures should move forward as they will help alleviate some of the traffic congestion and unnecessary delays in the study area. DPA reviewed the access plan for the project. The initial access plan had the majority of the parking spaces accessed from Sunset Drive (approximately 90% of the parking spaces). Access to the basement parking level was from SW 62 Avenue. The access plan should take into consideration the surrounding residential neighborhoods. The plan should try to minimize traffic impacts to these neighborhoods. The initial plan has the majority of the traffic exiting onto Sunset Drivc west of SW 62 Avenue. The only exiting movement allowed is a right tum to travel westbound on Sunset Drive. Given limited options, drivers tend to use any means necessary to get to their destination, including cutting-thru on rcsidential streets. The revised access plan is a complete modification to the initial access plan: the vast majority of the parking spaces are accessed from SW 62 Avenue. This access plan gives the vast majority of drivers much easier access to US-l and better protects the surrounding neighborhoods from potential cut-thru traffic.
