4 A Resolution of the Mayor and City Commission of the City of South
5 Miami, Florida, adopting a draft amendment to Article V, Section 2. A. of
6 the City Charter to change the City's official election month to April,
7 subject to a Referendum of City's electorate approving the amendment, and
8 to be placed on the ballot at the next election scheduled for February 9, 2016
9 and directing the City Clerk to take all necessary actions to carry out the
10 provisions of this resolution.

12 WHEREAS, the present election date requires candidates to campaIgn during the
13 holidays to the inconvenience of both the candidates and electorate; and
14
15 WHEREAS, the first week in April will allow the candidate to campaIgn III more
16 comfortable weather; and .

18 WHEREAS, South Miami electorate has indicated that they do not want to be included
19 in the county, state and federal election cycle; and
20·
21 WHEREAS, South Miami has many unique issues that would be lost III a ballot
22 concerning state, county and federal candidates and issues; and

24 WHEREAS, the City Commissioners desire to have a ballot question submitted to the
25 electorate for a referendum amending the City Charter to change the election month for City
26 elections to April by amending Article V, Section 2. A of the City Charter.

28 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
29 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

31 Section 1. The following question shall be submitted to the electorate of the City of South
32 Miami at the February 9, 2016 general City elections:

34 Title: Binding Referendum Amending Article V, Section 2. A. of the City of South
35 Miami Charter.

37 BALLOT QUESTION: Shall the City Charter be amended to change the election month
38 for City of South Miami general elections from February of each even year to April of
39 each even year commencing in 20_~ by amending Article V, Section 2. A of the City
40 Charter?

45 Ballot Summary: The intent of this charter amendment is to change the current election
46 month from February to April so as to eliminate the need to campaign during the

holiday season and permitting campaigning during cooler months.
If the question is approved by a majority of the voters in the general election, the Charter for the
City of South Miami shall be amended as follows (the underlined text will be added to the
existing Charter and the text with a line striking through it will be deleted from the existing
Charter):
ARTICLE V
SECTION 2. General Elections
A. Time General elections for the Commission shall be held
during FebFllIH'Y April, commencing in April of20 and thereafter
in April of each even year, the day, place and time to be set by
ordinance, at which time the Mayor shall be elected to a term of two
years and two Commissioners shall be elected to terms of four years.
Section 2: If any section clause, sentence, or phrase of this resolution is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity of the remaining portions of this resolution.
Section 3. Effective Date: This resolution shall become effective immediately upon
adoption by vote of the City Commission and, if approved by the electorate, the amendment to
the City Charter shall become effective ten (10) days following the date of the election held for
its approval.

There are 50 sworn offi-
cern in the department, with
one being hired last Friday.
Landa said that the depart-
ment added. a female officer
to the Explorer program
after the allegations. Landa
said a supervisor was also
added to the program, but
was already employed. when
the alleged events hap-
pened.
''When these things hap-
pen, we have so many
things in place, but we also
go hack and review all of
our policies and proce-
dures," Landa said. "We
review to make sure to see
what can we do to make this
better."
Landa encourages other
victims to come forvvard.
"We contacted every
single Explorer that was
with the program in the
past, was with the program
during the time that he was
there, and we notified and
contacted every single one
of them just to verify and
make sure," Landa said.
"Obviously if there is any
type of Explorer or under-
age child that this guy had
contact with, obviously we
would make sure and tell
everybody to please come
forward and let us mow and
advise the South Miami
police department inunedi-
ately."
The Public is advised that the South A MunIcipal Advisory Committee (MAC) will be holding a meeting
on Tuesday, OCiober27,2015 at 6:30 P.M. at DeelWood Bonita Lakes Park, 14445 SW 122nd Avenue,
Mlaml,33186.
The MAC will be evaluating the potential incorporation of the area into a separate municipality; It will also
be meeting with staff 10 diSCUSS the County's concerns regareing any adverse impact to the remaining
unincorporated municipal service area or other regional municipal-type services that could occur due 10
any such incorporation.
