A Resolution relating to a request for a variance of Section 20.4-4 of the Land Development
Code to reduce the maneuvering area or parking aisle from the required 23 feet to 22 feet within
a proposed interior parking garage of a large scale 5 story mix use building located at 620 I
Sunset Drive. The proposed development is zoned TODD MU-5.
BACKGROUND:
At the Commis sion meeting on September 1,2015 the developer's application for a Special Use
for a five story mixed use development with attached garage at 620 I Sunset Drive was tabled
and a request was made by the Commissioners for the developer to provide additional traffic
data. The developer agreed to the submission of a traffic study and was rescheduled for a
presentation to the Commissioners during the month of October 2015 .
The developer submitted a variance application for the reduction of the parking aisle dimen sions
from 23 feet to 22 feet within the garage of the proposed five story mix use development. The
Planning Board met on September 8, 2015 for a public hearing for the variance request.
ANALYSIS:
The variance application is for the reduction of the parking aisle dimensions from 23 feet to 22
feet within the garage of the proposed five story mix use development . The parking garage
provides for interior parking on five floors as well as the rooftop for a total of 295 parking
spaces. The parking design is for 90 degree parallel parking bays on each floor. The parking
garage is designed to provide a two-way traffic aisle for vehicle circulation throughout each level
of the garage for parking. The developer is requesting relief for 6 inches on both sides of the
aisle reducing the requirements from 23 feet to 22 feet. The parking regulations within the Land
Development Code (LDC) related to this development is in Section 20-S.8(D) and 20-4.4

(A) T.O.D.D. Parking Regulations
Parking in the T.O.D.D. must be developed and managed primarily as an element of
infrastructure critical to enhancing South Miami's tax base through economic success of the
district.

The developer meets the parking ratio in the Land Development Code which establishes the
number of parking spaces provided per unit of land use. The ratios recommended are based on
the expected peak accumulation of vehicles at peak hours daily; plus an effective supply cushion.
The proposed development is within the Transit Oriented Districts and this land use category is a
walkable area with a mix of land uses and these land uses are built around a mass transit system.
The developer is providing tenant space for first floor retail and the remaining four floors are for
office and medical office use. An overall design principle to keep in mind is that parking space
circulation needs will vary depending on the user type.
The proposed development will have auto orientated visitors along with transit and pedestrian
visitors; although the auto generated visitors will not be in the tradition sense of automobile
visitors seen in a commercial retail district as only the first floor is retail and the remaining floors
are for office space. The majority of the auto visitors will be for the office uses; which will
produce a lower turnover of traffic and movement within the garage. Also based on parking aisle
research of the neighboring City of Coral Gables their parking aisle requirement is 22 feet.
The developer is providing a 20 foot wide pedestrian arcade along the front street (Sunset Drive)
and the side street (62 nd Avenue) which creates a smaller overall building footprint. The variance
for narrowing of the parking garage maneuvering aisle by I foot will still provide sufficient drive
space into parking stalls. The Planning Board suggested moving the building back (North);
however that won't work as the building has a 5 foot rear setback; which is permitted by the
Land Development Code. The developer cannot move the building into the rear setback as this
will establish the need for a variance of setback.
PLANNING BOARD ACTION:
At the September 8, 2015 public hearing the Planning Board recommended approval of the
variance request contingent upon the Special Use approval from the Commissioners with a vote
of 4 to I.

6 WHEREAS, Oxford Universal Corporation submitted an application PB-15-013 for a

12 WHEREAS, the developer meets the Land Development Code requirements of Section
13 20-4.4 (C) Off Street Parking Dimensional Design Standards; which state that all required ofT-
14 street parking spaces shall be a minimum of nine (9) fect in width by eighteen (18) fect in depth.

16 WHEREAS, Granting the variance would be in keeping with the spirit and intent of
17 Section 20-8.8 Parking (A) T.O.D.D. Parking Regulations: Parking in the T.O.D.D. must be
18 developed and managed primarily as an element of infrastructure critical to enhancing South
19 Miami's tax base through economic success of the district.

21 WHEREAS, the variance is located within the parking garage and will not impact the
22 general public and would not alter the character of the area or be injurious to the use and
23 enjoyment of surrounding properties.

25 WHEREAS, the approval of a variance requires a recommendation from the Planning
26 Board and the approval of the City Commission after a public hearing; and

28 WHEREAS, at the September 8, 2015 public hearing the Planning Board recommended
29 approval of the variance request, contingent upon the Special Use approval from the
30 Commissioners, with a vote of 4 to I.

Mr. Lightfoot,
Please accept this application for a variance of section 20.4.4 related to the Off-Street Parking
requirements on a proposed development of a professional office and retail building and parking garage.
Other than this request, the proposed development meets all the guidelines as established in the TODD
MU-S district where this property is located. The project will include a 5 story office building with a
pedestrian arcade on the ground floor along the entire frontage along Sunset Drive and SW 62 Avenue.
The structure will also include a parking structure to accommodate 295 parking spaces. The parking
garage includes a basement level.
The property is located on the corner of Sunset Drive and SW 62 Avenue. The immediate neighbors,
other than the gas service station on the opposite corner, are all dedicated to medical uses. Baptist
South Miami Hospital owns all the abutting properties to this site. This building will also cater to the
growing demand of medical related facilities. The primary use for this project is intended to be medical.
Medical Use requires the highest parking requirements by City code. We have worked on numerous
designs for the project and the proposed garage design is the most effective to comply with all the code
requirements while allowing for the highest and best uses of medical, office and retail.
The variance being requested is based on the maneuvering area inside the parking garage. The code
requires a 23 foot width behind 90 degree parking spaces. See sketches from city code 20.4.4 below:

Please note the code also refers to maneuver areas alongside parallel parking spaces and entrance/exit
driveways which require a reduced width of only 22 feet.
The proposed garage does comply with 22 feet along the entrance/exit driveways. In the interior
sections of the garage along the two way traffic areas are proposed at the same 22 feet. This is a 6"
variance reduction request per lane of traffic restricted to the interior areas of the garage only. Due to
the configuration of the garage, the speed of traffic in these areas will naturally be very slow. Therefore,
we do not believe the slight reduction in lane width will not create any hazard for motorists.
We believe the criteria for this variance request meets the conditions set forth in the City codes. This
requested variance is the "minimal variance necessary to make possible the reasonable use of the
building". Another criteria states "the approval of the variance will be consistent with the general intent
and purpose of the Land Development Code, and will not be injurious to the neighborhood or otherwise
detrimental to the public welfare." We believe we comply with both these criteria.

te the two offices are min-
isterial and cannot prevent
the action.

that has done by the city
