201 RESOLUTION NO. ___ _ 2 3 A Resolution supporting the EPA's Clean Power Plan rule 4 as a way of significantly reducing greenhouse gas emissions 5 that threaten the City and South Florida region through 6 climate change and sea level rise and opposing any requests 7 that the Clean Power Plan rule he stayed during any periods 8 of legal challenge or litigation. 9 10 WHEREAS, The Mayor and City Commission recognize that greenhouse gas 11 emissions from human activity have been proven by the best science to be heating the 12 oceans and atmosphere, accelerating sea level rise, and acidifYing the planet's oceans; and 13 14 WHEREAS, all of South Florida, including the City of South Miami, is threatened 15 existentially by sea level rise induced by global warming; and 16 17 WHEREAS, On May 1, 2012, the City Commission unanimously approved a 18 resolution sending a letter to U.S. Environmental Protection Agency (EPA) Administrator 19 Lisa P. Jackson, supporting the EPA's increased efforts to reduce greenhouse gas 20 pollution under the Clean Air Act; and 21 22 WHEREAS, On August 3, 2015, the President and EPA announced the Clean 23 Power Plan -http://www2.epa.gov/cleanpowerplanlclean-power-plan-final-rule ; and 24 25 WHEREAS, the Clean Power Plan is an historic and important step in reducing 26 carbon pollution from power plants, and one that takes real action to limit human-induced 27 climate change; and 28 29 WHEREAS, the Clean Power Plan was shaped by years of unprecedented 30 outreach and public engagement, resulting in a fair, flexible plan, designed to strengthen 31 the fast-growing trend toward cleaner and lower-polluting American energy with strong 32 but achievable standards for power plants, and customized goals for states to cut the 33 carbon pollution that is driving climate change; and 34 35 WHEREAS, the Clean Power Plan provides national consistency, accountability, 36 and a level playing field, while reflecting each state's energy mix; and 37 38 WHEREAS, the Clean Power Plan furthers international cooperation on stemming 39 climate change by showing other nations that the United States is committed to leading 40 global efforts to address climate change. 41 42 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 43 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 44 45 Section 1. The City Commission hereby expresses its strongest support for the 46 federal Clean Power Plan rule and strongly opposes any and all requests that the Clean 47 Power Plan rule be stayed during any periods of legal challenge or litigation. 48 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 Section 2. The City Clerk is hereby directed to convey this resolution to EPA Secretary Gina McCarthy, and individually to all United States and Florida State Legislators representing the City of South Miami, to the Miami-Dade County Mayor, to members of the Miami-Dade County Commission, and to all cities in Miami-Dade County. Section 3. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution.
