18It I RESOLUTION NO. ___ _ 2 3 A Resolution instructing the City Manager and City Attorney to 4 draft necessary ordinances amending the City's Comprehensive 5 Plan, Zoning Map, and Land Development Code to the minimum 6 changes needed for the proposed Madison Square Project to 7 qualify for 9% Tax Credit financing. 8 9 WHEREAS, Madison Square has been the flagship project of the South Miami South 10 Miami Community Redevelopment Agency (SMCRA); and II 12 WHEREAS, the City desires to complete the Madison Square project; and 13 14 WHEREAS, the SMCRA Board has been unwilling to put all of the SMCRA's resources 15 into the Madison Square project, necessitating the use of 9% tax credit financing to complete 16 Madison Square; and 17 18 WHEREAS, the SMCRA signed a contract with Green Mills, to enable Green Mills to 19 develop the Madison Square project and apply for 9% tax credit financing; and 20 21 WHEREAS, the minimum number of units eligible for 9% tax credit financing was 22 subsequently increased to seventy-five; and 23 24 WHEREAS, certain components of the City'S Comprehensive Plan, Zoning Map, and 25 Land Development Code need to be amended to allow for this project to be eligible for 9% tax 26 credit financing; and 27 28 WHEREAS, the City has proposed to adjust, through ordinance, the Comprehensive 29 Plan, Zoning Map, and Land Development Code to allow for construction of 75 units on the 30 Madison Square project, consisting of 14 townhouse units on the SMCRA's Marshall 31 Williamson Property and 61 apartment units on the SW 64 th St Madison Square properties. 32 33 WHEREAS, staff prepared the initial ordinances to achieve this goal , allowing sufficient 34 latitude for the City Commission to make adjustments; and 35 36 WHEREAS, the City Commission wishes make such adjustments by limiting the 37 proposed changes to the minima that are required to achieve the desired goal; and 38 39 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 40 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 41 42 Section 1. The City Manager and City Attorney are hereby directed to prepare 43 amendments to the affected pending ordinances, and any new ordinances as necessary, so as to 44 provide the following for consideration by the City Commission: 45 46 L-Rezoning of the SMCRA 's Marshall Williamson property (Folios 09-4025-000-0850 47 and 09-4025-000-0852 and 09-4025-065-0090) to RM-18 , by ordinance, subject to the following 48 conditions: I 2 3 4 5 6 7 8 9 10 II 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 a) The construction site shall be restricted to the west side of the property facing SW 61 st Ct. b) The northeastern comer of Folio 09-4025-000-0850 ("Mango Lot") situated directly north of Folio 09-4025-000-0854 (Marshall-Williamson house) shall be retained as open space, to be rezoned as a passive neighborhood park upon recommendation of the SMCRA Board and approval of the City Commission. c) The number of townhouses to be constructed on the west side of the Marshall Williamson property shall be restricted to fourteen (14) units. 2. A base density and affordable housing bonus density that can be adjusted, by ordinance, to allow for construction of 61 apartment units on the Madison Square tracts adjoining SW 59 th Place and SW 64th St as follows [choose one 1: 2.a) Base density in areas zoned SR within the SMCRA but excluding the Hometown District shall be changed to thirty-five (35) units per acre and allow for an affordable housing density bonus of up to 30%, or 2.b) Base density in areas zoned SR within the SMCRA but excluding the Hometown District shall be changed to thirty-six (36) units per acre and allow for an affordable housing density bonus of up to 25%, or 2.c) Base density in areas zoned SR within the SMCRA but excluding the Hometown District shall be changed to thirty-eight (38) units per acre and allow for an affordable housing density bonus of up to 20%. Section 4. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 5. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this _ day of ___ , 2015.
