RESOLUTION NO. _____ _
A Resolution of the City of South Miami, Florida, authorizing the re-
allocation and use of the balance of the funds remaining, after the
engagement of an economist relating to early cost recovery matters before
the Public Service Commission, for the cost of an engineering expert witness
in the same matter.
WHEREAS, each year, Florida Power & Light Company, ("FPL") is authorized by
Florida's Public Service Commission to charge early nuclear cost recovery dollars to pay for
plarming, licensing, and eventually construction of its proposed nuclear reactors. To receive this
authorization, the utility must provide an armual feasibility analysis of its project, demonstrating
that the proposed power plant will be cost effective for its customers and that the utility intends
to continue with licensing, etc.; and
WHEREAS, the City of South Miami has partnered with the City of Miami and the
Village of Pinecrest, Florida in connection with the Early Cost Recovery matters before the
Florida Public Service Commission. In this regard, the City of South Miami has committed
$13,000 for the engagement of an economist by the City of Miami for the purpose to challenge
the assumptions behind FPL's feasibility analysis and present alternatives to the Public Service
Commission; and
WHEREAS, the actual cost of the City's share for the Public Service Commission expert
economist was $11,338.36, which left a balance of $1,661.64; and
WHEREAS, the City wishes to allocate and expend the unused funds of $1,661.64 to
contribute to the City of Miami's engagement of an engineering expert witness in connection
with the challenge to the assumptions behind FPL's feasibility analysis and present alternatives to
the Public Service Commission regarding the Early Cost Recovery matters.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The balance of the funds remaining after the engagement of an economist
by the City of Miami relating to Early Cost Recovery being sought by FPL before the Public
Service Commission are hereby re-allocated to and may be expended by the City of Miami
for the cost of an engineering expert witness concerning this matter.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
adoption by vote of the City Commission.
