A Resolution of the Mayor and City Commission of the City of South
Miami,Florida,adopting a draft amendment to Article V,Section 2.A.of
the City Charter to change the City's officialelection month to March,
subject toa Referendum of City's electorate approving the amendment,and
tobeplacedontheballotatthe next election scheduled for February 9,2016
and directing the City Clerk to take all necessary actions to carry out the
provisions of this resolution.
WHEREAS,thepresentelectiondaterequirescandidatestocampaignduringthe
holidays tothe inconvenience of both the candidates and electorate;and
WHEREAS,the first week in March will allow the candidate to campaign in more
comfortable weather;and
WHEREAS,South Miami electorate has indicated that they donot want tobe included
inthe county,stateand federal election cycle;and
WHEREAS,South Miamihasmanyunique issues that would belostina ballot
concerning state,county and federal candidates and issues;and
WHEREAS,the City Commissioners desiretohavea ballot question submitted tothe
electorate fora referendum amending theCity Charter to change the election month forCity
elections to March by amending Article V,Section 2.A of the City Charter.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.The following question shallbe submitted tothe electorate of the City of South
Miamiatthe February 9,2016 GeneralandSpecialCity elections:
Title:Binding Referendum Amending Article V,Section 2.A.of the City of South
Miami Charter.
BALLOT QUESTION:Shall theCity Charter be amended to change the election month
whentheCity of SouthMiamiholdsitsgeneral elections from February of eacheven
yearto March of eachevenyear commencing in2020by amending Article V,Section 2.

ARTICLE V
SECTION 2.General Elections
A.Time General elections for the Commission shall be held
during February March,commencing in March of 2020 and
thereafter in March of each even year,the day,place and time to be
set by ordinance,at which time the Mayor shall be elected toa term of
two years and two Commissioners shall be elected to terms of four
years.
Section 2:If any section clause,sentence,or phrase of this resolution isforany reason
held invalid or unconstitutional bya court of competent jurisdiction,the holding shallnot affect
the validity of the remaining portions of this resolution.
Section 3.Effective Date:This resolution shall become effective immediately upon
adoption byvote of theCity Commission and,if approved bythe electorate,the amendment to
theCity Charter shall become effective ten (10)days following thedate of the election held for
its approval.
