ORDINANCE NO.21-15-2228 An Ordinance vacating and abandoning 1,762.90 square feet of the unimproved right-of-way portion ofSW 44th Street and SW 64th Avenue,Folio No.09-4024-03 1170,and to quit claim the City's interest to the abutting property owners WHEREAS,theCity Commission hasthe power to vacate,abandon,discontinue and closean existing public or private street,alley-way,road,highway or other place used for travel orany portion thereof,other than astateorfederalhighway,andto renounce andquitclaimany right of theCityandthe public inandtoanylandin connection therewith;and WHEREAS,the City Engineer,recommended the vacating of that portion of unimproved right-of-way ofSW 44th Street and SW 64th Avenue,located on the northwest side of thepropertyidentifiedasfolio:09-4024-030-1170 wasnotservinganypublicpurposetothe Cityorthepublicandbecause,uponitsreversiontotheadjacent property owners,itwould constitute additional tax revenues totheCity;and WHEREAS,atthe August 11,2015 Planning Board meeting,and following a public hearing,theBoardreviewedapplication PB-15-011 andvoted6ayes,0naystorecommended approval of the request foraspecialusetovacateandabandon;and WHEREAS,theCity Commission desirestoacceptthe recommendation of the Planning Board. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1:The abandoned andunimprovedright of way known asthe portion of unimproved right-of-way of SW 44th Street and SW 64th Avenue,located on the northwest side of thepropertyidentifiedasfolio:09-4024-030-1170 andismorefullyandlegallydescribedin theattached Exhibit "A"isherebyvacated,abandoned,discontinued and closed^subject tothe followingconditions:Thesquarefootageintheeasementareatobe quit-claimed bytheCityto theapplicant/ownersshallnotbeusedtowardscalculation of buildingdensity,impervious coverage,orfootprint of thestructuresandimprovementsonthelotabuttingthepropertytobe vacated.It may,however,be used in determining yards and setbacks between structures and rights-of-wayandpropertylines.TheCityherebyrenouncesanyright of theCity,and of the public,tothepropertydescribedintheattachedExhibit"A"andherebyquitclaimsownershipin saidproperty,totheabuttingpropertyowners of the immediately adjacentproperty.The property owner shallpayoradvancethecostsassociatedwiththe abandonment of thisproperty, including costs of all publication concerning this ordinance andthe cost of recording of this ordinance,all attachments thereto andthe proof of publication.
