No. 08-96-1608ORDINANCE NO.8-96-1608 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE AMENDMENT OF SECTION 20-7.6(A)REGARDING THE HOMETOWN DISTRICT PARKING COMMITTEE MEMBERSHIP REQUIREMENTS;PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS,on October 19,1993,the City Commission adopted Ordinance No.19-93-1545,known as the "Hometown District Overlay Ordinance,"which amendedtheLandDevelopmentCodebycreatinga new Section 20-7.6 in the Land Development Code;and, WHEREAS,underthisnewSectiontheCityCommissioncreated a Hometown District ParkingCommitteein Section 20-7.6 (A);and, WHEREAS,theCommitteeistobe composed offourmembers appointed by the City Commission,the Mayor and all four City Commis sioners;and, WHEREAS,this may conflict withthe Sunshine Lawandwill require advertising,minutes,and essentially a second series of CityCommissionMeetings;and, WHEREAS,theMayorandtheCityCommissionfindthatitis in the public interest to provide for a less cumbersome method to gain recommendations regarding parking in the Hometown District. NOW,THEREFORE,BEITORDAINEDBYTHE MAYOR ANDCITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Section 20-7.6 (A)is amended to read as follows: Hometown District Parking Committee.Parking inthe Hometown Districtmustbe developed and managed primarily asanelementof infrastructurecritical to enhancing South Miami's tax base through economic success of the district.The—five—W—City Commiooioncro andfFour (4)privatecitizensandtheMayorshall serve asthe Hometown District Parking Committee charged with ... Section 3.All ordinances or parts of ordinances in conflict withtheprovisionsofthisordinanceare hereby repealed. Section 4.This ordinance shall take effect immediately at the time of its passage.
