Res No 161-15-14500RESOLUTION NO.161-15-14500 A Resolution declaring that the personal property,described in the attached list,is "surplus"and authorizing the CityManager to dispose of the "surplus" items. WHEREAS,Section 2-4.7 titled:"Surplus city-owned property"of the Cityof South MiamiCodeof Ordinances states that all personal property owned by the Cityshall not besold unlessanduntilitis declared tobe surplus property by resolution of the City Commission;and WHEREAS,the City Manager is recommending that the attached listof personal property items beclassifiedas "surplus"because said property serves nouseful function forany activity or inany location within the Cityandshouldbesoldto the highest bidder bywayofa City auction or as otherwise provided in section 2-4.7of the City Code of Ordinances;and NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITYOF SOUTH MIAMI,FLORIDA THAT; Section 1.The personal property described in the attached listof property is "surplus" and City Manager is hereby authorized to dispose of the items in accordance with the procedure set forth in section 2-4.7 of the City Code of Ordinances,including sale at public auction. Section 2.Severability.If any section,clause,sentence,or phrase of this resolution is forany reason heldinvalidor unconstitutional bya court of competent jurisdiction,thisholding shall not affect the validity of the remaining portions of this resolution. Personal Property is defined as temporary or movable property. Any personal property that is classified obsolete,orno longer economical or efficient to keep,or that serves no useful function for any activityorin any locationwithin the City,needs to be declared as "surplus"by the City Commission per Section 2-4.7 of the Code of Ordinances. Section2-4.7titled:"Surpluscity-ownedproperty"of the Cityof South Miami Code of Ordinances states that all personal property owned by the City shall not be sold unless and untilitis declared to be surplus propertybyresolutionofthecitycommission.The City Manager is recommending that the attached listof personal property items be classified as "surplus."While some of the personal property items declared surplus are in good orfair condition,they serve nousefulfunctionfor any activity orinany location within the City andshouldbesoldtothehighestbidderby way ofaCity auction. (b)The city commission shall not consider declaring any item of personal property tobe surplus unless the city manager has affirmatively recommended such action thereon. (c)Upon determination by resolution bythe city commission thatan Item ofpersonal property issurplus,thecity managerishereby authorized toselltothehighestbidder at public saleor,ifapproved bythe commission by resolution,atpublicauction,saiditemofpersonal property afteradvertisingthedate,timeandplaceofsaid saleorauctiononceaweekforthree(3)consecutiveweeksinanewspaperofgeneral circulation inthe city. Thecitymanagershallhavethe right toacceptorrejectanyor alf bids.Intheeventthepersonalpropertyshall beofferedforsaleorauction,andnobidsshallbe received therefor,itshallbedeemedthatsuchpropertyhas novalueandthe city manager inhisdiscretionmayorderit destroyed orotherwise disposed of.
