An Ordinance amending the official zoning map as provided in the City Of South Miami Land
Development Code, Article III, "Zoning Regulations," Section 20-3.1(C), and other applicable
provisions, amending the designation of the Marshall Williamson Property located at
approximately SW 51 st Court And SW 64th Terrace, from Small Lot Single-Family Residential
District RS-4 to Low Density Multi-Family Residential District RM-18.
BACKGROUND:
The City desires to foster development that benefits its residents and construction of affordable
and workforce housing is an established goal in the City's Comprehensive Plan. In order to
implement affordable housing projects such as the Madison Square project, it is necessary to
provide for a sufficient level of development in order to qualify for funding opportunities. The
increase of residential development intensities in targeted zoning districts to provide for the
development of sustainable affordable and workforce housing is an appropriate means to
implement these strategies and has been made necessary by the State of Florida's policies to
encourage more provision of affordable housing opportunities by raising the minimum level of
units to be able to qualify for tax credits which in most cases are essen~ial to the funding of
such developments.
The City's Comprehensive Plan, Housing Element, Housing Policy 1.5.2, was established to
encourage affordable housing within the City, and encouraged the granting of a density
increase, which is compatible with surrounding development and site characteristics. To this
end, and by separate action the City Commission will consider increasing the bonus for
affordable, low affordable, and workforce housing to 30%.
The land use map designation amending the designation of the Marshall Williamson Property
located at approximately SW 51 st Court And SW 64 th Terrace, needs to be revised from Small
Lot Single-Family Residential District RS-4 to Low Density Multi-Family Residential District RM-
18, to enable the Madison Square project to be constructed with the appropriate minimum
number of units within the entire project.
ANALYSIS:
The proposed Zoning Map amendment will provide for a zoning map change to RM-18 on the
Marshall Williamson property. These units are part of a housing strategy to provide
workforce/affordable housing units known as the Madison Square Development. The proposed
changes have been recommended by the community and are compatible with the surrounding
area and will encourage and enable the further development of affordable and workforce
housing which is needed in the area. The folio numbers for the Land use Map amendment are:

STAFF RECOMMENDATION:
This ordinance will modify the City of South Miami's Zoning Map for Marshall Williamson
property. The present RS-4 Small Lot Single Family Residential District will be changed to RM-
18 Low Density Multi-family Residential Family. Staff recommends approval of first reading of
this Ordinance and subsequent referral to the September 29, 2015 Special Planning Board
meeting for their review and recommendation. Second reading of the Ordinance by the City
Commission is scheduled for October 14.

11 WHEREAS, the City Commission of the City of South Miami is interested III
12 providing housing opportunities to all of its residents; and
13
14 WHEREAS, the South Miami Comprehensive Plan in its Housing Element contains
15 Goals, Objectives and Policies that support and encourage the provision of affordable housing
16 in the City; and
17
18 WHEREAS, Housing Objective 1.1 provides that "[t]he City shall support public and
19 private efforts to provide at least 1 00 additional housing units ... ;" and
20
21 WHEREAS, Housing Policy 1.5.2 provides that "[i]n consideration of a developer's
22 provision of affordable housing, the City shall consider granting a density increase
23 proportional to the number of units provided but not exceeding a 20% increase, to the extent
24 that such an increase is compatible with surrounding development and site characteristics;"
25 and
26
27 WHEREAS, the Community Redevelopment Agency ("CRA") entered into the
28 "Agreement Between Developer [Strategic Green Mills Investments, Inc.] and the City of
29 South Miami Community Redevelopment Agency" on November 7, 2013 to provide for
30 affordable housing on the Madison Square properties, at approximately SW 64 tli Street and
31 SW 60 th Avenue; and

33 WHEREAS, included within the scoje of the Madison Square project are parcels at
34 approximately SW 51 st Court and SW 64 Terrace known as the Marshall Williamson
35 property; and
36
37 WHEREAS, it is necessary to include the Marshall Williamson property in the
38 Madison Square project in order to provide sufficient units to meet financing and tax
39 incentive requirements for the project; and
40
41 WHEREAS, the City has prepared a small-scale Futrtre Land Use Map amendment to
42 change the designation of Marshall Williamson property, also known as the 1.01 acre subject
43 property located at approximately SW 51 st Court and SW 64 th Terrace, from Single Family
44 Residential (2-Story) to Multiple-Family Residential (4-Story) on the Future Land Use Map;
45 and
46
47 WHEREAS, the Planning Board has reviewed or will be reviewing the proposed
48 amendments to the Zoning Map after first reading, and it has held or will be holding an
49 advertised public hearing, which did or will provide for public participation in the process and
50 has render its recommendation to the City Commission prior second reading of this ordinance.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1. That the City of South Miami adopts the amendment to the Official Zoning Map
changing the designation for the Marshall Williamson property, also known as the 1.01 acre
subject property located at approximately SW 51 sl Court and SW 64th Terrace, from Single
Family Residential (2-Story) to Multiple-Family Residential (4-Story) on the Future Land Use
Map. A copy of the pertinent part of the map as amended is attached to this ordinance.
Section 2. Codification. The provisions of this ordinance shall become and be made part of
the Official Zoning Map of the Land Development Code of the City of South Miami as
amended.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall
not affect the validity of the remaining portions of this ordinance or the Guidelines adopted
hereunder.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and
parts of sections of ordinances in direct conflict herewith are hereby repealed.
Section 5. Effective Date. This ordinance shall become effective upon enactment.
