3 An Ordinance amending Chapter 2, Article I, Section 2-2.1 (J) to change the
4 procedure and requirements for addressing the City Commission.

6 WHEREAS, City Commission meetings generally take place at night; and
7
8 WHEREAS, many speakers at City Commission meetings are female; and
9
. 10 WHEREAS, there may be a danger if a speaker announces his or her address before
11 speaking to the City Commission at a public meeting at night; and
12
13 WHEREAS, the City Commission desires to amend Chapter 2, Article I, Section 2-2.1

16 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
17 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

19 Section 1: Chapter 2, Article I, Section 2-2.1, and specifically subsection (J) titled
20 MANNER OF ADDRESSING COMMISSION; TIME LlMIT, of the City of South Miami's Code of
21 Ordinances shall be amended to read as follows:

23 Section 2-2.1 Rules of Procedure of City Commission
24
25 The following rules of procedure shall govern all meetings of the city commission,
26 namely:

30 (J) MANNER OF ADDRESSING COMMISSION; TIME LIMIT. No person shall
31 address the commission from the audience. Each person, before addressing the
32 commission-,-shall first legibly print their full name and their residential address and sign
33 in the space provided on the speaker list, step up to the podiunl, speak into the
34 microphone,shadl give his eF heF state the person's name and ad8ress city ofresidence
35 and, if not a resident of the City of South Miami, state whether the person has a business
36 interest in the City and its address. The person shall speak in an audible tone of voice for
37 the public record, and unless further time is granted by the commission, shall limit his or
38 . her address to five (5) minutes or lUltil statements appear to be repetitive or obstructive as
39 determined by the presiding officer. All remarks shall be addressed to the Ceommission
40 as a body and not to any member. No person, ether th!lfl tile perseR h!Wing the fleer,
41 addressing the COimnission shall be pennitted to ask questions of or to enter into any
42 discussion with any member of the Commission, or any City Officer while they are
43 seated on or beside the dais while a Commission meeting is in progress, either directly or
44 through a member of tlle cOimnission, without the pennission of the presiding officer. We

47 Section 2: Codification. The provisions of this ordinance shall become and be made
48 part of the Code of Ordinances of the City of South Miami as amended; that the sections of this

1 ordinance may be renumbered or re-lettered to accomplish such intention; and that the word
2 "ordinance" may be changed to "section" or other appropriate word.

4 Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is
5 for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
6 shall not affect the validity of the remaining portions of this ordinance.

8 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
9 sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.

11 Section 5. Effective Date. This ordinance shall become effective upon enactment.
