Resolution approving a special exception waiving strict compliance with the provisions of the
hometown district overlay parking requirements, to locate a general restaurant at 5894
Sunset Drive within the Specialty Retail "SR", Hometown District Overlay "HD-OV".
BACKGROUND:
1. This property in the past was operating as a restaurant with an approved special use permit
doing business as Trattoria Sole Italian Cuisine. The parking calculations requirement for this
property is sixteen (16) parking spaces. There are two (2) parking spaces in front of the building
along Sunset Drive which the owner will receive a credit of two (2) parking spaces, but will still
need to fulfill the condition of 14 parking spaces to meet all requirements established in the
Hometown Overlay District Zone.
Site Location
2. The new business owner has submitted an application and is requesting relief from the parking
requirement of fourteen (14) spaces; which requires an annual payment of $14,000 into the
hometown parking fund per Section 20-7.6(C)(2)(b) that state:
If there are fewer spaces provided than required for existing buildings, the applicant
may obtain a special exception waiving the number of additional spaces required in
accord with the process set forth in Section 20-7.51 of the Land Development Code; or
pay into the Hometown District Improvement Trust Fund a Jee Jor each space required
but not provided.
Furthermore, pursuant to Section 20-7.6(C)(2)(c) of the Land Development Code,
The Jee Jor each space shall be one thousand dollars ($1,000.00) per parking space per
year payable at the time oJ renewal oJ the occupational license. This Jee may be
adjusted periodically by the City Commission as appropriate.
ANALYSIS:
Pursuant to Section 20-7.51(A) of the Land Development Code, the proposed restaurant use mu,st.
comply with the following parameters: • '

1. The proposed development contributes to, promotes and encourages the improvement of tHe
Hometown District and catalyzes other development as envisioned in the Hometown District
regulations.
The proposed restaurant use will contribute to, promote and encourage the improvement of the
Hometown District and occupy a vacant corner structure along Sunset Drive; as well as
compliment the adjacent restaurants located along SW 59 th Avenue.
2. The proposed development is compatible with the land uses and development intensities
prescribed by all applicable city regulations.
The proposed restaurant use is compatible with the land uses and development intensities in the
Hometown District.
3. The proposed development must possess integrity of design compatible with the design
criteria established for the Hometown District and with the overall image of the city.
The proposed restaurant possesses integrity of design that is compatible with the design criteria
established for the Hometown District. Furthermore, its design is keeping with the overall image
of the city.
4. The proposed development shall be designed in a manner that provides for effective
management of traffic (vehicular and pedestrian), parking, lighting, noise and waste
generated by the development, and management of the impacts of the development on public
facilities and services.
The existing structure is located along 10 foot wide sidewalk which provides for effective
management of pedestrian movement. There are two dedicated parking spaces along Sunset
Drive, although the restaurant use will create the need for additional parking. There is adequate
lighting, noise, and waste generated by this restaurant that will not create a nuisance as it is
adjacent to similar uses.
5. The proposed development does not expand the permitted uses within the Hometown
District.
The proposed restaurant use will be established within the existing structure and does not
expand into adjacent structures along Sunset Drive or SW 59'" Avenue.
6. The proposed development will not have an unfavorable effect on the economy of the City of
South Miami.
The proposed restaurant use will not have an unfavorable effect on the economy of the City of
South Miami. In fact it will contribute by occupying a presently vacant structure and adding to the
downtown attraction for residents and visitors.
7. The proposed development, when considered cumulatively with other development, both
present and future, within the Hometown District, will not create excessive overcrowding or
concentration o/peop/e or population.
The proposed restaurant use, when considered cumulatively with other development, both
present and future, within the Hometown District is determined to be of a compatible and
complementary nature with the existing and future planned surrounding uses
It is important to note that the Hometown District urban design features provide for connectivity to
alternative modes of transportation via mass transit, bicycles and pedestrian corridors; although the
proposed restaurant use by code will still generate the need for additional dedicated parking spaces
as some visitors will arrive via automobile.
Because of proximity to the public parking garage on SW 58th Court, the recommendation made by
the Planning Department to the Planning Board was for a relief of seven (7) of the fourteen (14)
required parking spaces; which would require that the applicant make an annual payment of $7,000
into the hometown parking fund.
PLANNING BOARD ACTION:
At the August 11, 2015 Planning Board meeting and following a public hearing, the Board
deadlocked with a vote of 3-3 with no recommendation thus forwarding of the special exception
application, PB-15-010, to the Mayor and Commissioners.
RECOMMENDATION:
The location for the proposed restaurant is at the corner of Sunset Drive and SW 59th Avenue. The
building is a critical corner for restaurants along SW 59 th Avenue and a visual anchor for the gateway
entry into the Hometown District. It is the recommendation of staff that the Commission reach a
resolution to solve the applicant's request for parking requirements as this location, which can help
to vitalize the intersection.

8 WHEREAS, SPIRITCO, LLC submitted Application No. PB-15-010 on August II,
9 2015 requesting approval of a special exception to the required number of parking spaces to
10 establish a restaurant located at 5894 Sunset Drive within the SR (HD-OV) zoning district; and

12 WHEREAS, the applicant is requesting a special exception waiving strict compliance
13 with the Hometown District Overlay parking requirements and payment to Hometown Parking
14 Fund; and
15
16 WHEREAS, Section 20-7.12 Restaurant, General or Walk Up requires 1 parking space
17 per 100 sf devoted to patron use and 1 parking space for 300 sf devoted to non-patron use; and
18
19 WHEREAS, Section 20-7.6 Parking (C) (2) (c) provides that the fee payment into the
20 Hometown District Improvement Trust Fund for each space required but not provided shall be
21 one thousand dollars ($1,000.00) per parking space per year payable at the time of issuance of
22 the occupational license and at the time of renewal of the occupational license. This fee may be
23 adjusted periodically by the City Commission as appropriate; and

25 WHEREAS, Section20-7.5J titled Special Exception provides that the city commission
26 may. by special exception, waive strict compliancc with the provisions llfthc Homctown District
27 Overlay Ordinance. In granting a special exception, the city commission must find by substantial
28 competent evidence that:

30 (I) The proposed development contributes to, promotes and encourages the improvement

(2) The proposed development must possess integrity of design compatible with the

8 WHEREAS, the approval of a special exception requires a recommendation from the
9 Planning Board and the approval of the City Commission after a public hearing; and

11 WHEREAS, the City Planning Department's staff recommendations at the public
12 hearing informed the Planning Board that the applicant is required to provide 16 parking spaces.
13 The Planning Department also stated that the applicant will receive a parking credit for the two
14 parking spaces located in front of the establishment along Sunset Drive reducing his parking
15 requirement to 14. It was also mentioned by the Planning Department that relief to the applicant
16 could be established by requiring the applicant to pay $7,000 into the Hometown Parking Fund
17 for 7 parking spaces and the balance of the remaining 7 parking spaces could be provided by the
18 public parking garage located within one block of proposed restaurant; and
19
20 WHEREAS, the Planning Board at its August 11, 2015 public hearing motioned to
21 modified the recommendation of the Planning Department for the applicant to limit the waiver to
22 only one year. This motion ended in deadlock vote 3-3; and
23
24 WHEREAS, the Planning Board at its August 11, 2015 public hearing made a second
25 motion to support the Planning Department's recommendation as is; without a one ycar term and
26 the second motion also resulted in a deadlock vote 3-3; and
27
28 WHEREAS, the Planning Board at its August 11, 2015 public hearing made a motion,
2 9 and approved the motion to rehear the item; and

31 WHEREAS, the Planning Board at its August 11, 2015 public hearing made a third
32 motion to modified the recommendation of the Planning Department for the applicant to be
33 approved but for only three years. This motion died for lack of a seconded; and
34
35 WHEREAS, the Planning Board at its August 11, 2015 public hearing made a
36 recommendation to forward the special exception application PB-15-0 1 0 to the commissioners
37 for decision; and
38
39 WHEREAS, the City Commission desires to approve the Special Exception.

41 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY

44 Section 1: Special Exception Application (PB-15-0 1 0) submitted by applicant
45 SPIRITCO, LLC, to reduce the number of parking spaces and the required fee payment into the

On behalf of Spiritco, LLC I am hereby presenting this application for a Special Exception to waive
parking fees related to the new restaurant at the above referenced address.
I have acquired the space at the above address, where Trattoria Sole used to be. The location no longer
carries a valid license, therefore I have to submit this application. Due to this fact and in order to
operate the restaurant at this location, we need to go by new regulations, including new parking fees.
As you may know, restaurants operate with very tight margins. The new parking fees can jeopardize the
economic viability of the business. Aside from rent being really high and under triple net lease, I still
need to carry the cost of having valet parking, which is extremely necessary and expensive. I do not
believe it's fair that we pay a penalty because others failed to renew the license. I am sure you
understand my concern and I respectfully ask you to waive the parking fees related to the new license.
It is our great hope that you will view our application positively.
We look forward to working with you throughout this process and will be happy to discuss any questions
you may have.
