A Resolution for special use approval to permit a general restaurant at 5894 Sunset Drive
within the Specialty Retail "SR", Hometown District Overlay "HD-OV".
BACKGROUND:
This property in the past was operating as a restaurant with an approved special use doing
business as Trattoria Sole Italian Cuisine. The special use approval has expired for the prior
restaurant because it has been closed for more than six month s. There are two parking spaces
and a large awning in front of the building along Sunset Drive to provide cover for outdoor
dining.

ANALYSIS:
(A) General Requirements .
l. The proposed special use approval is determined to be of a compatible and
complementary nature with the existing or planned surrounding uses.
2. The approval of this special use will have no future adverse effects that will harm the
health or safety of persons residing or working in the vicinity of the proposed use, or be
detrimental to the public welfare, property, or improvements in the neighborhood . The
special use approval may be modified or revoked by the City Commission upon
notification and public hearing.
3. The proposed special use approval shall allow only inside dining. If the business owner
wishes to provide outdoor dining along the right-of-way of Sunset Drive or Dorn
Avneue, the owner must seek the review and approval of the City Manager.
4. The proposed special use approval will not provide services thru a drive-in and of a fast
food nature shall not be permitted.
PLANNING BOARD ACTION:
At the August 11, 2015 Planning Board meeting and following a public hearing, the Board voted
5-1 to recommend approval of the special use application PB-15-009.
RECOMMENDATION:
Staff recommends approval for the Special Use application to operate a general restaurant at
5894 Sunset Drive .

7 WHEREAS, pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC),
8 the applicant, SPIRITCO, LLC submitted Application No. PB-15-009 to the Planning Board
9 requesting a Special Use Approval to operate a general restaurant located at 5894 Sunset Drive,
10 within the Specialty Retail "SR", Hometown District Overlay "HD-OV" zoning district; and
11
12 WHEREAS, the applicant proposes to lease the existing vacant space that will front on
13 Sunset Drive; and
14
15 WHEREAS, restaurants are permitted as a special use within the Specialty Retail "SR",
16 Hometown District Overlay "HD-OV" zoning district and is subject to meeting general
1 7 conditions specified in LDC Section 20-5.8 and subject to meeting special use requirements set
18 forth in LDC Section 20-3.4(B)(4)(b); and

20 WHEREAS, the applicant's restaurant special use meets the special use requirements set
21 forth in LDC Section 20-3.4(B)(4)(b) which are:
22 i. All such establishments shall provide only inside or patio service on private
23 property. Public streets, rights-of-way, sidewalks and required setbacks may not be used
24 for patio or street-side services of any kind.
25 H. No services of a drive-in or of a fast food nature shall be permitted.
26 HI. The city commission shall review and recommend approval, disapproval or
27 modification of all site plans and project specifications for this special use permit; and
28
29 WHEREAS, the approval of a special use requires a recommendation from the Planning
30 Board and the approval of the City Commission after a public hearing; and
31
32 WHEREAS, at the August II, 2015 Planning Board meeting, and following a public
33 hearing, the Board reviewed application PB-15-009 and voted 5 ayes, I nays to recommended
34 approval of the request for a special use to operate a restaurant; and
35
36 WHEREAS, the City Commission desires to accept the recommendation of the Planning
37 Board.

39 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
40 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

42 Section 1: Special Use Application (PB-15-009) submitted by applicant SPIRITCO,
43 LLC, to operate a restaurant located at 5894 Sunset Drive, within the Specialty Retail "SR",
4 4 Hometown District Overlay "HD-OV" zoning district is hereby approved subject to the
45 following terms and conditions as well as all applicable City ordinances, codes, rules and
1 regulations:
2 (I) Adhere to the Special Conditions applicable in Section 20-3.4(B)(4)(b)Generai
3 Restaurant and Section 20-5.8 Special Use Approval of the Land Development Code,
4 listed.
5 (2) All signage for the new establishment is subject to approval by the Planning
6 Department; external signage for the new establishment is limited in size and location to
7 the existing signage for the previous occupant of spaces.
8 (3) Any and all exterior renovations or modifications for the new establishment is subject
9 to approval by the ERPB
10 (4) A separate application for outdoor dining would be required as per Section 20-
11 3.3(E)(2) Outdoor Seating / Dining for all commercial Properties, of the Land
12 Development Code.
13 (5) If the subject general restaurant is determined by the Planning and Zoning Director in
14 the future, to be adversely affecting the health or safety of persons residing or working in
15 the vicinity of the proposed use, or to be detrimental to the public welfare or property or
16 improvements in the neighborhood, or not be in compliance with other applicable Code
17 provisions, the special use approval may be modified or revoked by the City Commission
18 upon notification and a public hearing.

20 Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
21 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
22 not affect the validity ofthe remaining portions of this resolution.

24 Section 3. Effective Date. This resolution shall become effective immediately upon
25 adoption by vote of the City Commission.

20-3.4 Special use Conditions, LDC
Any of the following special uses may be approved and permitted by the city commission at a
public hearing, after a recommendation by the planning board, provided that such use is
specifically listed as a permitted special use in the appropriate district column in the Permitted
Use Schedule (Section 20-3.30), and that such use complies with the following general and
special requirements and any other conditions that the city commission may consider
appropriate and necessary:
(A) General Requirements.
(1) All such uses shall comply with all requirements established in the appropriate zoning
use district, unless additional or more restrictive requirements are set forth below or
by the city commission.
(2) All such uses shall be determined to be of a compatible and complementary nature
with any existing or planned surrounding uses.
(3) A public hearing shall be held by the city commission to determine the overall
compatibility of the use with the surrounding neighborhood.
(4) If a special use is, in the future, determined by the Director of Planning, to be
adversely affecting the health or safety of persons residing or working in the vicinity
of the proposed use, to be detrimental to the public welfare or property or
improvements in the neighborhood, or to be not in compliance with other applicable
Code provisions, the special use approval may be modified or revoked by the City
Commission upon notification and public hearing.

restaurant at the above referenced address.
I have acquired the space at the above address, where Trattoria Sole used to be. The location no longer
carries a valid license, therefore I have to submit this application. The idea is to reopen the place with
the same Italian concept, with a refreshed look, family style environment and using top quality
ingredients.
I have already been operating a restaurant in South Miami for over five years, Old Lisbon Sunset. And
being familiarized with the area, I believe an Italian restaurant of high quality is a great fit for the town. I
have chefs that have a lot of experience with Italian food, and I'm very confident with their skills and my
experience, we can put together a winning concept in the city of South Miami.
