An Ordinance amending Chapter 2,Article I,Section2-2.1(J)tochangethe
procedure and requirements foraddressingthe City Commission.
WHEREAS,CityCommissionmeetingsgenerallytakeplaceatnight;and
WHEREAS,manyspeakersatCityCommissionmeetingsarefemale;and
WHEREAS,theremaybeadangerifaspeakerannounceshisorheraddressbefore
speakingtotheCityCommissionatapublicmeetingatnight;and
WHEREAS,theCity Commission desirestoamend Chapter 2,ArticleI,Section2-2.1

NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1:Chapter2,ArticleI,Section2-2.1,andspecificallysubsection(J)titled
MANNER OF ADDRESSING COMMISSION;TIME LIMIT,of theCity of South Miami's Code of
Ordinances shall be amended to read as follows:
Section 2-2.1 Rules of Procedure of City Commission
The following rules of procedure shallgovernall meetings of thecity commission,
namely:

(J)MANNER OF ADDRESSING COMMISSION;TIME LIMIT.No person shall
addressthe commission fromtheaudience.Each person,before addressing the
commission,shallfirst legibly printtheirfullnameand their residential addressandsign
inthespace provided onthe speaker list,stepuptothe podium,speakintothe
microphone,shall givehisor hef statethe person's name and address city of residence
and,if nota resident of theCity of SouthMiami,state whether thepersonhasabusiness
interest intheCityanditsaddress.Thepersonshallspeakin anaudible tone of voicefor
thepublicrecord,andunlessfurthertimeisgrantedbythe commission,shalllimithisor
heraddresstofive(5)minutesoruntilstatementsappeartoberepetitiveorobstructiveas
determined bythe presiding officer.All remarks shallbe addressed tothe Ceommission
asabodyandnottoanymember.No person^rQther thanthepersonhavingthe fleefr
addressingtheCommissionshallbepermittedtoaskquestions of ortoenterintoany
discussion with any member of the Commission,or any City Officer while they are
seatedonorbesidethedaiswhileaCommissionmeetingisinprogress,eitherdirectlyor
throughamember of thecommission,withoutthepermission of thepresidingofficer.Ne
questionshallbeaskedacommissionerexceptthroughthepresiding offieePr
Section 2:Codification.The provisions of this ordinance shall become andbemade
part of the Code of Ordinances of theCity of South Miami as amended;that the sections of this
Ord.No.20-15-2227
ordinance maybe renumbered or re-lettered to accomplish such intention;andthattheword
"ordinance"maybechangedto"section"orotherappropriateword.
Section3.Severability.Ifanysection,clause,sentence,orphraseofthisordinanceis
foranyreasonheldinvalidor unconstitutional byacourtof competent jurisdiction,this holding
shallnotaffectthe validity of the remaining portions of thisordinance.
Section 4.Ordinances in Conflict.All ordinances or parts of ordinances andall
sectionsandparts of sections of ordinancesindirectconflictherewithareherebyrepealed.
Section 5.Effective Date.This ordinance shall become effective upon enactment.
