WHEREAS,SPIRITCO,LLC submitted Application No.PB-15-010 on August 11, 2015 requestingapproval of aspecialexceptiontotherequirednumber of parkingspacesto establish a restaurant located at 5894 Sunset Drive within theSR (HD-OV)zoning district;and WHEREAS,the applicant isrequestingaspecial exception waiving strict compliance withthe Hometown District Overlay parking requirements and payment to Hometown Parking Fund;and WHEREAS,Section 20-7.12 Restaurant,General or Walk Up requires 1 parking space per 100 sf devoted to patron useand1 parking spacefor300 sf devoted to non-patron use;and WHEREAS,Section 20-7.6 Parking (C)(2)(c)provides that the fee payment intothe Hometown District Improvement Trust Fundforeachspace required but not provided shallbe one thousand dollars ($1,000.00)per parking spaceperyear payable atthetime of issuance of the occupational license andatthetime of renewal of the occupational license.This feemaybe adjusted periodically bytheCity Commission as appropriate;and WHEREAS,Section 20-7.51 titledSpecial Exception provides that thecity commission may,byspecial exception,waivestrictcompliancewiththe provisions of the Hometown District OverlayOrdinance.In granting aspecialexception,thecity commission mustfindbysubstantial competent evidence that: (1)Theproposeddevelopmentcontributesto,promotesandencouragestheimprovement of theHometownDistrictandcatalyzesotherdevelopmentasenvisionedinthe Hometown District regulations. (2)Theproposeddevelopmentmustpossessintegrity of designcompatiblewiththe designcriteriaestablishedforthe Hometown Districtandwiththeoverallimageof thecity. (3)Theproposeddevelopmentshallbedesignedinamannerthatprovidesforeffective management of traffic(vehicularandpedestrian),parking,lighting,noiseandwaste generatedbythedevelopment,andmanagement of theimpacts of thedevelopmenton public facilities and services. (4)Theproposeddevelopmentdoesnotexpandthepermitteduses within theHometown District. (6)The proposed development,when considered cumulatively with other development, both present andfuture,within the Hometown District,willnot create excessive overcrowding or concentration of people or population;and WHEREAS,the approval of a special exception requires a recommendation fromthe Planning Board and the approval of theCity Commission aftera public hearing;and WHEREAS,the City Planning Department's staff recommendations atthe public hearing informed the Planning Board thatthe applicant is required to provide 16 parking spaces. The Planning Department also stated thatthe applicant will receive a parking credit forthetwo parking spaces located infront of the establishment along Sunset Drive reducing his parking requirement to14.It was also mentioned bythe Planning Department that relief tothe applicant couldbe established byrequiringthe applicant topay$7,000intothe Hometown Parking Fund for7 parking spacesandthebalance of the remaining 7 parking spaces could be provided bythe public parking garage located within one block of proposed restaurant;and WHEREAS,the Planning Board atits August 11,2015 public hearing motioned to modifiedthe recommendation of thePlanningDepartmentfortheapplicanttolimitthewaiverto only one year.This motion ended in deadlock vote 3-3;and WHEREAS,the Planning Boardatits August 11,2015 public hearing madeasecond motion to support the Planning Department's recommendation asis;without aoneyeartermand the second motion also resulted ina deadlock vote 3-3;and WHEREAS,thePlanningBoardatitsAugust 11,2015 publichearingmadeamotion, and approved the motion to rehear theitem;and WHEREAS,thePlanningBoardatitsAugust 11,2015publichearingmadeathird motiontomodifiedthe recommendation ofthePlanningDepartmentfortheapplicanttobe approved but foronly three years.This motion diedfor lack of a seconded;and WHEREAS,thePlanningBoardatitsAugust 11,2015publichearingmadea recommendationtoforwardthespecialexceptionapplication PB-15-010 tothecommissioners for decision;and WHEREAS,theCity Commission desires toapprovetheSpecial Exception. BACKGROUND: 1. This property in the past was operating as a restaurant with an approved special use permit doing business as Trattoria Sole Italian Cuisine. The parking calculations requirement for this property is sixteen (16) parking spaces. There are two (2) parking spaces in front of the building along Sunset Drive which the owner will receive a credit of two (2) parking spaces, but will still need to fulfill the condition of 14 parking spaces to meet all requirements established in the Hometown Overlay District Zone. Site Location 2. The new business owner has submitted an application and is requesting relief from the parking requirement of fourteen (14) spaces; which requires an annual payment of $14,000 into the hometown parking fund per Section 20-7.6(C)(2)(b) that state: If there are fewer spaces provided than required for existing buildings, the applicant may obtain a special exception waiving the number of additional spaces required in accord with the process set forth in Section 20-7.51 of the Land Development Code; or payintothe Hometown District Improvement Trust Fund afeeforeachspacerequired but not provided.
