ORDINANCE NO.33-83-1191
AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,
AMENDING 8-4 ACCESSORY USES,OF ARTICLE VIII,OF
SECTION 1 OF ORDINANCE NO.20-71-724,HERETOFORE
ADOPTED AS THE OFFICIAL ZONING ORDINANCE OF THE
CITY OF SOUTH MIAMI,FLORIDA,BY:ADDING NEW SUB
SECTION 8-4-8 ALLOWING CARPORTS AS AN ACCESSORY
USE IN THE FRONT SETBACK IN RESIDENTIAL DISTRICTS;
PROVIDING REGULATIONS FOR CONSTRUCTION,LOCATION
AND MAINTENANCE OF SAID CARPORTS;AMENDING SUB
SECTION 10-1-2.22,DEFINITIONS,BY DEFINING CARPORT;
AND ALSO AMENDING SUBSECTION 7-2-10,AWNINGS,TO
ALLOW CARPORTS ASAN ACCESSORY USE UNDER THE PRO
VISIONS OF THE NEW SUBSECTION 8-4-8;REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE
WITHAND PROVIDING AN EFFECTIVE DATE.
WHEREAS,the Planning Board has considered the amendments herein requested
and made a recommendation of approval thereof;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That Section 8-4 of Article VIII of Section 1 of Ordinance No.
20-71-724,heretofore adopted as the Official Zoning Ordinance of the City of South
Miami,Florida,be,and the same is hereby amended by adding a new subsection 8-4-8
allowing carports as an accessory use,to-wit:

New carports may be constructed as accessory structures
in the front setback in residential districts subject
to the following regulations:
The height of said carport shall not exceed ten (10)
feet,measured from ground level to the uppermost
pointofthecover.
b.The width and length of said carport shall not exceed
twenty (20)feet.
The location of said carport shall be at least five
(5)feet from the front property line and seven feet -
six inches (7'-6")from the side property line.
d.Permitted cover materials shall be canvas or other
flexible,weather-proof,canvas-like material.
Permitted vertical supports shall be metal pipe not to
exceed three (3)inches in diameter.
f.No more than one (1)such carport structure shall be
allowed per residence.

sides if attached to the main building.
h.The carport structure shall have a cover on at all times
Said cover to be maintained in good (i.e.free from
tears,holes and fading)condition.Should any such
cover become deteriorated,it shall be the owner's
responsibility to ensure that this cover is properly
restored to its origial condition,or in the event
restoration is not possible,that it is replaced with a
new cover of the type prescribed in this ordinance.
Under no circumstances shall the carport structure re
main coverless or with a deteriorated cover for more than
fifteen (15)days subsequent to notification by the*City
't aviolation exists.
i.In additiontotheabove outlined criteria,thecarport
shall be approved by the Environmental Review and
Preservation Board.
.02 Carports located within front setbacks in residential
districts and existing asofthe date of this ordinance
shall be consideredconforming accessory structures,
providing all the following requirements are met
within thirty (30)days of notification by the City
of South Miami:
a.A permit is obtained from the Building Department.
b.The subject carport complies with all applicable main
tenance criteria as set forth in 8-4-8.01,is used
solely for the storage of operable automobiles or boats
and is kept open of all four (4)sides,if freestanding,
and three (3)sides if attached to the main building.
Section 2.That subsection 10-1-2.22,Carport,of Article X of Ordinance
No.20-71-724,heretofore adopted as the Official Zoning Ordinance of the City of
South Miami,Florida,be,and the same is hereby amended by redefining carport,
to-wit:
10-1-2.22 Carport
A covered structure open on all four (4)sides,if free
standing,or on three (3)sides if attached to the main
building,for the purpose of providing shelter for
operableautomobilesor boats.
Section 3.That subsection 7-2-10,Awnings,of Article VII,of Ordinance
No.20-71-724,heretofore adopted as the Official Zoning Ordinance of the City of
South Miami,Florida,be,and the same is hereby amended to allow carports asan
accessory use under provisions of new subsection 8-4-8,to-wit:
7-2-10 Awnings
Awnings,canopies or other metal,canvas or fabric-
covered shelters shall not be designed,placed or
used for parking of motor vehicles between the right-
of-way and the front building line except in residential
districts as provided in subsection 8-4-8.
Section 4.All ordinances or parts of ordinances in conflict herewith be,
and the same are hereby repealed.
Section 5.This ordinance shall take effect immediately at the time of its
passage.
