ORDINANCE NO..13-83-1173
AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,
AMENDING ARTICLE V OF SECTION 1 OF ORDINANCE NO.
20-71-724,HERETOFORE ADOPTED AS THE OFFICIAL ZONING
ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,BY:
ADDING A NEW SECTION 5-17,ENTITLED "H -HOSPITAL",
CONTAINING PURPOSES,USES PERMITTED,SPECIAL USES PER
MITTED,AND DISTRICT REGULATIONS FOR SAID NEW DISTRICT;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CON
FLICT THEREWITH,AND PROVIDING WHEN THIS ORDINANCE SHALL
TAKE EFFECT.
WHEREAS,the Planning Advisory Board of the City of South Miami
has considered a proposed new District entitled:"H-Hospital",and have
made their recommendations thereon.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMIS
SION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That Article V of Section 1 of Ordinance No.20-71-724,
heretofore adopted as the Official Zoning Ordinance of the City of South Miami,
Florida,be,and the same is hereby amended by adding immediately after Section
5-16,the following new section,to-wit:
5-17 "H"Hospital District
5-17-1 Purpose
The purpose of this district shall.be to provide upon
approval of a special use permit therefor,an area that
will accommodate the various needs of the South Miami
Hospital in a manner that will allow the hospital to
continue to provide the excellent health care that it
.presently provides and yet be compatible with the resi
dential area immediately tothe west.
The unique nature of a large hospital and its quickly
changing needs and characteristics makes proper regu
lation of such an institution under ordinary commercial
or office zoning regulations difficult at best.These
same characteristics also make large hospitals located
adjacent to single family residential areas,such as the
South Miami Hospital,both assets in terms of the jobs
and services provided,and a liability in terms of the
traffic generated and the propensity for such institu
tions to grow.
Therefore,it is the intent of the creation of this dis
trict to try to establish a stable land use pattern in
the hospital area upon which both the local residents
and the South Miami Hospital itself can rely.To assist
the South Miami Hospital in its efforts to continue to
provide excellent health care,the creation of this dis
trict has provided approximately 3.0 acres of additional
area for hospital expansion subject to the limitations
listed below.
However,the city hereby puts the hospital andother
area property owners onnoticethatit does not intend
toextend non-residential usesanyfurtherwestthanthe
east side of S.W.63rd Avenue.To that end,the
hospital and other interested parties should make
their future plans knowing that such changes in land
use are not-intended and should govern themselves
accordingly.
5-17-2 Uses Permitted
.01 Single family dwellings,subject to all RS-3 requirements
.02 Accessory uses,which are subordinate to,supportive of,
compatible with,and customary in connection with per
mitted residential dwellings.
5-17-3 Special Uses Permitted
.01 The construction of new hospital buildings or expansion
or conversion of existing hospital buildings and related
accessory uses or the demolition of existing structures
provided that:
(a)Such construction,expansion,conversion,or demo
lition shall:(1)not create additional traffic on
adjacent residential streets;(2)not overburden any
public or quasi-public facility such as streets,water
and sewer lines,and the like,except that the hospital
may agree to provide or expand any needed facility at
no added cost to the public;(3)be compatible with
the surrounding area and conform to the South Miami
Comprehensive Plan.
(b)The City Commission shall hold a public hearing
to determine whether the plans as proposed or amended
meet the requirements of this Section 5-17,and other
generally applicable regulations.
(c)The City Commission may attach such conditions and
safeguards to an approval of a Special Use Permit as
are reasonably necessary and required to protect public
interest in (1)completion of the development according
to approved plans,(2)provision for continuing opera
tion and maintenance of such areas,facilities,and func
tions as are not to be provided,operated,or maintained
at general public expense,and (3)provision for such
dedications,contributions,or guarantees as are required
for provision of needed public facilities and services.
(d)The statements of paragraph (c)preceding shall not
be deemed to deny to the City Commission the authority to
set other conditions and safeguards at the time of special
permit approval,but where such conditions and safeguards
are attached the Commission shall determine that they are
reasonably necessary and required to protect the public

5-17-4 District Regulations

Section 5-3-3.
All single family residential uses shall be subject to the

for the CO (Commercial Office)district,as listed in
Section 5-11-5,except that a strip of land 135 feet
wide and running north/south immediately east of the
Oak Heights Subdivision shall be limited to a six (6)
story or sixty-five (65)foot height limitation which
ever isless.
Non-residential uses in the Oak Heights Subdivision shall
be subject to the district regulations listed for the
Residential Office district as listed in Section 5-10-4,
except that the floor area ratio limitations of Sub-
Section 5-10-4.04 shall not apply and the following
additional limitations shall apply:
(a)A heavily landscaped buffer twenty-five (25)feet
in depth will be required along the entire property line
facing S.W.63rd Avenue/Manor Lane in all property being
used for non-residential purposes.
(b)A one story or twenty (20)foot height limitation,
whichever isless.
(c)No vehicular access shall be allowed to or from
S.W.63rd Avenue/Manor Lane for property being used for
non-residential purposes.
All proposed developments shall be accompanied by an over
all site plan,as defined in Article XI,reflecting all
significant aspects of the development.Properties ad
jacent to the proposed development shall be taken into
consideration and a reasonable portion of these areas
shall also be reflected on the site plan.
Section 2.All Ordinances or parts of Ordinances in conflict here
with be,and the same are hereby repealed.
Section 3.This Ordinance shall take effect immediately at the
time of its passage.
