AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,
REQUIRING SUBMISSION OF FEES,RATES AND EXPENSES
WITH PROPOSAL FOR PROFESSIONAL SERVICES CONTRACTS
ANDTO MAKE SAME A FACTOR IN THE SELECTION PROCESS
AND OTHER PROCEDURAL PROVISIONS FOR SELECTION OF
PERSONS QUALIFIED,INTERESTED AND AVAILABLE AND
PROVIDINGANEFFECTIVE DATE.
BE IT ORDAINED BYTHE MAYOR ANDTHE CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.The City Manager shall require interested
persons to submit a quotation of their proposal fees for the performance of
professional services hereinafter described unless such interested persons are
prohibited by law.
Section 2."Professional Services"shall mean those
services within the scope of the practice of architecture,professional
engineering,or registered land surveying,as defined by the laws of the
State,or those performed by any architect,professional engineer,or registered
land surveyor in connection with his professional employment or practice.
Section 3.Selection of Persons Qualified,Interested
and Available:
(A).From those persons evidencing an interest in performing
the services,the City Manager shall:
(i)prepare an alphabetical list of those persons
determined by the City Manager to be qualified,
interested and available;and
(ii)designate three (3)persons on the alphabetical
list considered by the City Manager to be the
best qualified to perform the work required.
(B).The best qualified selection shall be based upon the
City Manager's ability to differentiate qualifications
applicable to the scope and nature of the services to
be performed.
(C).The City Manager shall determine qualifications,interest
and availability by reviewing all written responses
received that express an interest in performing the
services,and,when necessary,by conducting formal
interviews of selected respondents that are determined
to be the best qualified based upon the evaluation of
of written responses.The determination shall be based
on the following considerations:
(i)competenance,including technical education and
training,experience in the kind of project to be
undertaken,availability of adequate personnel,
equipment and facilities,the extent of repeat
business of the persons,and,where applicable,
the relationship of construction cost estimates
by the person to actual costs on previous projects;
(ii)current work load;
(iii)financial responsibility;

(iv)ability to observe and advise whether
plans and specifications are being complied
with,where applicable;
(v)past record of professional accomplishments;
(vi)proximity to the project involved;
(vii)past record of performance for the City;
(viii)ability to design an approach and work plan
to meet the project requirements,where
applicable;and
(ix)quotation of rates,fees or charges and other
detailed cost proposal or cost breakdown
information.
The absence of professional experience in a specialized
area shall not inhibit proper consideration of other
wise qualified,competent persons.
In determining the best qualified persons,the City Manager
shall give preference to persons having local places of
business where no other differentiation in qualifications
can be made.
The City Manager shall submit to the City Commission his
report and recommendations together with the above
specified requirements for final selection by the City
Commission by resolution.
Section 4.The procedures of Section 287.055 of the Florida Statutes are
otherwise applicable.
Section 5.This ordinance shall take effect immediately at the time of
its passage.
