An Ordinance creating Section 2-4.9in Chapter 2,Article I,of the City of
South Miami's Code of Ordinances establishing an alternative enforcement
procedures for ordinances and statutes pursuant to Chapter 162,Florida
Statutes.
WHEREAS,theCity of South Miami has been vested with home rule power to enact
ordinances that do not conflict with state law;and
WHEREAS,theCity of South Miami ("City")has previously enacted Section 2-24and
2-25 pursuant to Chapter 162,Florida Statutes,which isa procedure primarily designed to
adjudicate violations of the City's building and zoning ordinances;and
WHEREAS,Chapter 162,Florida Statutes,provides an alternative code enforcement
procedure to that provided fora Code Enforcement Board ora Special Master procedures and
which authorizes imprisonment for violations of certain City ordinances;and
WHEREAS,this proposed ordinance willalso provide the City's police department with
an alternative procedure for enforcement of civil citations issued in lieu of arrest for certain
misdemeanors anditwill create an additional mechanism under the City's Codeto enforce these
and other violations.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Chapter 2,Article I,of the City of South Miami's Code of Ordinances,is
hereby amended to create a new Section 2-4.9 which shall read as follows:
Section 2-4.9 CODE ENFORCEMENT
(1)Intent:Theintent of thisSectionistoprovideanalternativetotheSpecialMastercode
enforcement process set forth in Section 2-24and2-25andfor the enforcement of codes
and ordinances of the City and all ordinances of Miami-Dade County and statutes of the
state that the City is authorized to enforce,unless an alternative enforcement method is
designated by an ordinance.
(2)Definitions:
a.As used in this Section,"code enforcement officer"means any designated
employee or agent of the City whose duty itisto enforce codes and ordinances
enacted bythe county or municipality including law enforcement officers.
(3)CodeEnforcementOfficer:TheCitymaydesignatecertain of itsemployeesoragentsas
codeenforcementofficers.Thetrainingandqualifications of theemployeesoragentsfor
suchdesignationshallbedeterminedbytheCity.Employeesoragentswhomaybe
designated as code enforcement officers may include,but are not limited to code
inspectors.Designationasacodeenforcementofficerdoesnotprovidethecode
enforcement officer withthepower of arrestorsubjectthecode enforcement officerto

theprovisions of ss.943.085-943.255unlessthecodeenforcementofficerisalsoalaw
enforcement officer.Nothing inthis Section amends,alters,or contravenes the provisions
of any state-administered retirement system orany state-supported retirement system
established by general law.
(4)Issuance of Citations.
a.Code enforcement officer are authorized to issue a citation toa person when,
basedupon personal investigation,theofficerhasreasonablecauseto believe that
the person has committed acivil infraction in violation of adulyenactedcodeor
ordinance and that the county court will hear the charge.
b.Prior to issuing a citation.Thecode enforcement officer shall provide notice to
the person that the person has committed a violation of a code or ordinance and
shall establish a reasonabletime period within which the person must correct the
violation if the violation is correctable.Such time period shallbeno more than 30
days.If,upon personal investigation,a code enforcement officer finds that the
person has not corrected the correctable violation within the time period,thecode
enforcement officer mayissuea citation tothe person whohas committed the
violation.A code enforcement officer does not have to provide the person with a
reasonable time period to correct the violation prior to issuing a citation andmay
immediately issue a citation if a repeat violation isfoundor if thecode
enforcement officer hasreasontobelievethatthe violation presentsaserious
threat tothepublichealth,safety,orwelfare,or if the violation is irreparable or
irreversible.
c.A citation issued by a code enforcement officer shall contain the following
information:
i.The date and time of issuance.
ii.The name and address of the person to whom the citation isissued.
iii.The date and time the civil infraction was committed.
iv.The facts constituting reasonable cause.
v.The number or section of the code or ordinance violated.
vi.The name and authority of the code enforcement officer.
vii.Theprocedureforthepersontofollowinordertopaythecivilpenaltyor
to contest the citation.
viii.Theapplicablecivilpenalty if thepersonelectstocontestthecitation.
ix.The applicable civilpenalty if the person electsnottocontestthecitation.
x.Aconspicuousstatementthat if thepersonfailstopaythecivilpenalty
withinthetimeallowed,orfailstoappearincourttocontestthecitation,
the person shall be deemed to have waived hisorher right to contest the
citationandthat,insuchcase,judgmentmaybeenteredagainsttheperson
foranamountuptothemaximumcivilpenalty.
(5)Enforcement:
a.Afterissuingacitationtoanallegedviolator,if theviolatorfailstopaythefine
within ten (10)days of issuance,and the code enforcement officer intends to seek
court enforcement,theofficershalldeposittheoriginalcitationandonecopyof
the citation with the county court.

b.The enforcement of the City Ordinances may include,but shall not be limited to,
the issuance of a citation,a summons,ora notice to appear in county court or
arrestfor violation of municipalordinancesasprovidedforinchapter901.Unless
otherwisespecificallyauthorizedandprovidedforbylaw,apersonconvictedof
violating aCity ordinance maybesentencedtopayafine,nottoexceed$500,
and may be sentenced toadefiniteterm of imprisonment,notto exceed 60days.
c.The code enforcement officer mayissuea notice to appear atany hearing
conducted bya county court if theofficer,based upon personal investigation,has
reasonable cause to believe thatthepersonhas violated acodeorordinance.A
noticetoappearmeansawrittenorderissuedbyacodeenforcementofficerin
lieu of physical arrest requiring apersonaccused of violatingthelawtoappearin
a designated court or governmental officeata specified dateandtime.Prior to
issuing a notice toappear,acode enforcement officer shallprovide written notice
tothe person that the person hascommitteda violation of acodeor ordinance and
shall establish a reasonable timeperiod within which the person must correct the
violation if itis correctable.Suchtime period shallbenofewerthan5daysand
no more than 30days.If,upon personal investigation,acode enforcement officer
finds that the person hasnot corrected the violation within the prescribed time
period,the officer may issue anoticeto appear tothe person whohas committed
the violation.The code enforcement officer isnot required to provide the person
with a reasonable time period to correct the violation prior to issuing a notice to
appear and may immediately issuea notice to appear if a repeat violation isfound,
or if the code enforcement officer has reason to believe that the violation presents
a serious threat tothe public health,safety,or welfare or that the violator is
engaged in violations of an itinerant or transient nature,as defined by the City's
code or ordinance,or if the violation is irreparable or irreversible.
(6)Any person who willfully refuses tosignand accept a citation issued byacode
enforcement officer shallbeguilty of a misdemeanor of theseconddegree,punishable as
provided ins.775.082 ors.775.083.
(7)The provisions of thispartshallnotapplytothe enforcement pursuanttoss.
553.79and553.80 of the Florida BuildingCodeadoptedpursuanttos.553.73asapplied
to construction,provided thatabuildingpermitiseithernotrequiredorhasbeenissued
bythe county orthe municipality.
(8)The provisions of thisSectionareadditionaland supplemental means of enforcing
the City's codes and ordinances and may be used for the enforcement of any code or
ordinance,or for the enforcement of all codes and ordinances.Nothing contained in this
Section shall prohibit the City from enforcing its codes or ordinances byany other means.
Section 2.Codification.The significant provisions of thisordinanceshallbecomeand
bemadepart of theCode of Ordinances of theCity of SouthMiamiasamended;thatthesections
of thisordinancemayberenumberedorre-letteredtoaccomplishsuchintention;andthatthe
word"ordinance"maybechangedto"section"orotherappropriateword.

Section 3.Severability.If anysection,clause,sentence,orphrase of thisordinanceis
foranyreasonheldinvalidorunconstitutionalbyacourt of competent jurisdiction,thisholding
shallnotaffectthe validity of the remaining portions of this ordinance.
Section 4.Ordinances in Conflict.Allordinancesorparts of ordinancesandall
sectionsandparts of sections of ordinancesindirectconflictherewithareherebyrepealed.
Section 5.Effective Date.This ordinance shall become effective upon enactment.

162.21 Enforcement of county or municipal codesor ordinances;penalties.—
(1)Asusedinthissection,"codeenforcementofficer"meansanydesignatedemployeeor
agentofacountyormunicipalitywhosedutyitistoenforcecodesandordinancesenactedbythe
county or municipality.
(2)Acountyoramunicipalitymay designate certainofits employees oragentsascode
enforcementofficers.Thetrainingandqualifications of theemployeesoragentsforsuch
designationshallbedeterminedbythecountyorthemunicipality.Employeesoragentswho
maybedesignatedascodeenforcementofficersmayinclude,butarenotlimitedto,code
inspectors,law enforcement officers,animalcontrolofficers,orfiresafetyinspectors.
Designationasacode enforcement officerdoesnotprovidethecodeenforcementofficerwith
thepower of arrestor subject thecode enforcement officer tothe provisions of ss.943.085-

health,safety,or welfare,or if the violation is irreparable or irreversible.
(c)A citation issued byacode enforcement officer shallbeinaform prescribed bythecounty
orthe municipality and shall contain:
1.The date and time of issuance.
2.The name and address of the person to whom the citation is issued.
3.The date and time the civil infraction was committed.
4.Thefacts constituting reasonable cause.
5.The number or section of the code or ordinance violated.
6.Thenameand authority of thecode enforcement officer.
7.Theprocedureforthepersontofollowinordertopaythecivilpenaltyortocontestthe
citation.
8.The applicable civil penalty if the person electsto contest the citation.
9.The applicable civil penalty if the person electsnotto contest the citation.
10.Aconspicuousstatementthat if thepersonfailstopaythecivilpenaltywithinthetime
allowed,orfailstoappearincourttocontestthecitation,thepersonshallbedeemedtohave
waivedhisorherrighttocontestthecitationandthat,insuchcase,judgmentmaybeentered
againstthepersonforanamountuptothemaximumcivilpenalty.

(4)Afterissuingacitationtoanallegedviolator,acodeenforcementofficershalldepositthe
original citation and one copy of the citation withthe county court.
(5)Acountyora municipality isauthorizedtoenforcecodesandordinancesunderthe
provisions of thissectionandmayenactanordinanceestablishingproceduresforthe
implementation of such provisions,includingaschedule of violationsandpenaltiestobe
assessedbycode enforcement officers.If acountyor municipality chooses toenforcecodesor
ordinancesunderthe provisions of thissection,eachcodeorordinanceortheordinanceenacted
bythecountyor municipality establishingproceduresfor implementation of thissectionshall
provide:
(a)That a violation of a code oran ordinance isa civil infraction.
(b)A maximum civil penalty not to exceed $500.
(c)Acivil penalty of less than the maximum civil penalty if the person whohas committed the
civil infraction does not contest the citation.
(d)For the issuance of a citation byacode enforcement officer whohas reasonable cause to
believe that a person has committed anactin violation of acodeoran ordinance.
(e)For the contesting of a citation in county court.
(f)Such procedures and provisions asare necessary to provide forthe enforcement of acodeor
an ordinance under the provisions of this section.
(6)Any person who willfully refuses tosignand accept a citation issued byacode
enforcement officer shallbeguilty of a misdemeanor of theseconddegree,punishable as
provided ins.775.082 ors.775.083.
(7)The provisions of this part shallnotapplytothe enforcement pursuant toss.553.79and
553.80 of the Florida Building Codeadoptedpursuanttos.553.73asappliedtoconstruction,
provided that a building permit is either not required orhas been issued bythe county orthe
municipality.
(8)The provisions of this section areadditionaland supplemental means of enforcingcounty
or municipal codesor ordinances andmaybeusedforthe enforcement of anycodeor ordinance,
orforthe enforcement of allcodesandordinances.Nothing contained inthissectionshall
prohibitacountyor municipality fromenforcingitscodesorordinancesbyanyothermeans.

162.22 Designation of enforcementmethodsandpenaltiesforviolationofmunicipal
ordinances.—The governing body of amunicipalitymaydesignatetheenforcementmethodsand
penaltiestobeimposedfortheviolationofordinancesadoptedbythe municipality.These
enforcementmethodsmayinclude,butarenotlimitedto,theissuance of acitation,asummons,
oranoticetoappearincountycourtorarrestfor violation of municipal ordinances as provided
forin chapter 901.Unless otherwise specifically authorized and provided forbylaw,aperson
convicted of violatingamunicipalordinancemaybesentencedtopayafine,nottoexceed$500,
andmaybe sentenced toadefinitetermof imprisonment,nottoexceed60days,ina municipal
detentionfacilityorotherfacilityasauthorizedbylaw.

(1)Notwithstanding s.34.07,acode enforcement officer,designated pursuanttos.162.21(1)
and(2),mayissueanoticetoappearatanyhearing conducted byacountycourtifthe officer,
baseduponpersonal investigation,has reasonable causetobelievethatthepersonhasviolateda
codeorordinance.Anoticetoappearmeansawrittenorderissuedbyacodeenforcementofficer
inlieuofphysicalarrestrequiringapersonaccusedofviolatingthelawtoappearinadesignated
courtorgovernmentalofficeataspecifieddateandtime.If apersonissuedanoticetoappear
underthissectionrefusestosignsuchnotice,thecodeenforcementofficerhasnoauthorityto

162.30 Civil actions to enforce county and municipal ordinances.—In addition to other
provisions of law authorizing the enforcement of countyand municipal codesand ordinances,a
county or municipality may enforce any violation of a county or municipal codeor ordinance by
filingacivil action inthe same manner as instituting acivilaction.The action shallbe brought in
county or circuit court,whichever is appropriate depending upon the relief sought.Counties and
municipalities are authorized and required topayanycounsel appointed bythecourtto represent
aprivate party insuch action if the provision of counselat public expenseis required bythe
Constitution of theUnitedStatesortheConstitution of theState of Floridaand if thepartyis
indigentas established pursuant tos.27.52.Thecountyor municipality shallbearallcourtfees
andcosts of anysuchaction,andmay,if itprevails,recoverthecourtfeesandcostsandexpense
of thecourt-appointedcounselaspart of itsjudgment.Thestateshallbearnoexpense of actions
broughtunderthis section except thosethatitwouldbearinanordinarycivilactionbetween
