3 A Resolution of the City of South Miami ("City") enabling the
4 vaccination and spaying or neutering of feral cats within the City
5 limits.

7 WHEREAS, the City of South Miami has been designated a Tree City USA community
8 and a bird sanctuary; and
9
10 WHEREAS, it is now imperative that the City of South Miami become an animal
11 protective city with regard to feral cats; and
12
13 WHEREAS, more than 400,000 stray cats live on the streets of Miami-Dade County;
14 and
15
16 WHEREAS, South Miami has a large feral cat population; and
17
18 WHEREAS, each female cat can give birth to up to 12 kittens per year; and
19
20 WHEREAS, the feral cats endanger the bird population South Miami; and
21
22 WHEREAS, feral cats can spread disease and may be carrying rabies which can harm
23 domesticated pet cats and even residents; and
24
25 WHEREAS, spaying and neutering of feral cats will help reduce their numbers and help
26 curb overpopulation as well as protect against the spread of disease when they are vaccinated.

28 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
29 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:

31 Section 1. The recitals above have been found to be true and correct and are adopted by
32 reference herein.

34 Section 2. The City of South Miami shall budget $5,000 for the cost of trapping,
35 vaccinating and neutering or spaying of feral cats.

37 Section 3. The City of South Miami shall encourage the formation of a private committee
38 of interested citizens of the City of South Miami for the purposes of trapping and feeding feral
39 cats that have been spayed or neutered.

41 Section 4. The City of South Miami shall provide the traps and transportation of the
42 trapped feral cats to a local veterinarian that has agreed to accept a fee not to exceed $ __ per
43 vaccination, spaying and/or neutering.

Section 5. If any section clause, sentence, or phrase of this resolution is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity of the remaining portions ofthis resolution.
Section 6. This resolution shall take effect immediately upon adoption.
