Staff recommends approval (on both requests). The applicant is requesting to amend the RO portion of the zoning ordinance by creating a special use permit to allow a two level parking structure with specific conditions.The applicant is then requesting a special use permit for a project which meets the conditions set forth in the amended ordinance. Staff's recommendation on the first request is based heavily on the appli cant's proposal of amending the special use section of the zoning district and not the uses permitted.Reviewing each project on an individual basis with attention given to the special circumstances of each application creates the option of approval versus the requirement of approval.This process affords the applicant the opportunity of presenting those aspects of the project which are beneficial to the City and perhaps even supercede zoning requirements.In addition to this applicant,the proposed amendment would afford at least four other property owners (7221,7231 and 7241 S.W.63 Avenue and 6919 S.W.62 Avenue)a similar opportunity. In reference to the second request,staff's recommendation is based primari ly on the alleviation of additional traffic on 63 Avenue which would have occured with the development of a professional office building on the project site.One of the proposed special use conditions prohibits access from the RO zoned portion of the property.Realizing the sensitivity of the surround ing neighborhood to traffic infiltration,this aspect of the project becomes the single most important feature. The proposed parking structure would serve an additional 20,350 square feet of office space.Together with the existing building,the applicant is pro posing approximately 53,350 square feet of office space for the total site. Disregarding economics,the maximum allowable square footage for the property is approximately 70,000 square feet for the CO zoned portion and 9,144 square feet for the R0 zoned portion.Combined,the maximum allowable for this site is approximately 79,144 square feet or 48.3%larger than the proposed project. On the issue of the effectiveness of a parking structure as a buffer between residential and commercial office uses,the proposal is not as clear. Visually,a two story,residential office building would make the transition easier on the eye than a structure with a maximum finished floor height of 4'-6";however,when presented with the proposed project on a preliminary level,the Environmental Review and Preservation Board found it aesthetically acceptable. Lots 9,10,11 Beaver Homesites Plat Book 41 Page 69 7331S.W.63 Avenue Chairman Michel son read,for the minutes,a letter of objection from Harbor Heights Development Corp.as follows: This is an objection to the application for creation of a special use for the property described as 7331 S.W.63 Avenue (lots 9,10,11 Beaver Homesites Plat Book 41 Page 69.) As owners of the property abutting said properties we object. As owners of lots 5,6,7 and 8 Beaver Homesites,we were required by the City as a condition of receiving a building permit,to design a building and land scaped area which would preserve the residential flavor of the neighborhood. Our parking was required to be incorporated into the visual aspect of the property. This present application is for a structure which will completely change the nature and atmosphere of the neighborhood and make our own property less attractive. By this letter,we also appoint Michael A.Jullie to act as our prerepresen- tative in any proceedings before the Planning Board or the City Commission. The letter is signed by Dennis Berger,Vice President and notarized by Michael A.Jullie. Mr.Alan Gold,attorney representing the applicant,addressed the Board and introduced Mr.Ben Guilford and Jeff Fein,Principals,Mr.Tom Brown,archi tect and Mr.Michael Spencer,Landscape architect. Mr.Gold presented the plans to the Board and drew their attention to the fact that the plans have been presented to the Environmental Review and Preservation Board which gave conceptual approval.He further stated that a neighborhood meeting had been held during which the plans had been present ed to those interested parties and questions answered. The proposed addition to the existing medical building would be three floors and a penthouse for a total of 20,000 square feet.Tho addition is permis- sable under CO zoning.The proposed parking deck,second level,will be elevated four feet,six inches (4*-6")above grade with an additional wall over that to a hieght of eight (8')feet.Extensive landscaping is planned for the residential side as well as the back side (north)using a berm rising to the height of the wall.This will completely hide the parking deck from the street.There will be no access to parking from S.W.63 Avenue,there by further preserving the residential ambiance. Mr.Michael Spencer presented the landscape plans along with Mr.Tom Brown. Hedging and screen material will be used on the lower portion of the berm giving way to shade trees which will rise to 20 to 25 feet to screen any structure.Two of the large trees,already on the property,will be saved as landmarks and landscaping is also planned for the terraces of the building. Chairman Michelson asked if the hedge was in conflict with the zoninq or dnance with reference to height.Mrs.Wheeler responded that the hedqe would not be a problem since it was away from the v operty line and was not a continuous solid feature.
