ORDINANCE NO.4-84-1199 ANORDINANCEOFTHECITYOFSOUTH MIAMI,FLORIDA, GRANTING A VARIANCE TO ALLEN DRUG COMPANY TO ALLOW FOUR HUNDRED EIGHTY-TWO (482)SQUARE FEET OF EXISTING NEON SIGNS WHERE TWO HUNDRED SIXTEEN (216)SQUARE FEET OF SIGNAGE IS THE MAXIMUM ALLOWED AS TO CERTAIN DESCRIBED PROPERTY LOCATED AT4000REDROAD, SOUTHMIAMI,FLORIDA. WHEREAS,the Planning Board of the City of South Miami has considered the variance herein granted and recommended approval thereof;and WHEREAS,Staff of the City of South Miami has considered the request herein granted and made recommendation thereon; NOW,THEREFORE,BEIT ORDAINED BYTHE MAYOR ANDTHE CITYCOMMISSIONOFTHECITYOFSOUTHMIAMI,FLORIDA: Section 1.That Allen Drug Company be,and is hereby granted a variance to allow 482 square feet of existing neon signs where 216 square feet of signage is themaximum permitted as to certain described property located at 4000 Red Road,South Miami,Florida,and legally described as: ATTEST: Lot 11,Block2,WESTERFIELD MANOR, as recorded in Plat Book 18at Page 47of the Public Records of Dade County,Florida. Legal description:Lot 11,block 2 Westerfield Manor Plat Book 18 Page 47 Location:4000 Red Road Mr James S.Dunn of 45 Giralda Avenue addressed the Board representing Allen Drug Company.He explained that his clients were seeking a variance because of the uniqueness and age of the sign which has been in place for thirty or forty vears.Further,he pointed out that all other signage on the building has*been removed and/or painted out to conform to the sign ordinance.A petition in favor of retaining the neon sign,which Mr.Dunn said carried 1,896 signatures of residents of Dade County,Coral Gables and South Miami,was presented to the Board. Mr John Allen,Jr.addressed the Board and reiterated the fact that all other signage had been removed from the building,and windows.He also stated that he felt the corner signage was most important to the identifi cation ofthe business. David Smith,at the request of Chairman Smith,read the staff recommendation for denial,which cited,for reason,that there i*no inherent hardship m theland. Mr Dunn returned to tell the Board that the entire buildinq was,to be re painted,possibly as soon as the followinq week,pending coordination of color and timing with the tennants adjacent (Chevalier Liquors). Chairman Smith deemed the public hearing closed. MOTION:By Edward Coburn to allow the siqn to exist ?.is. Seconded by Rev.C.E.Standifer. Mr.Michelson stated that he felt that this siqn would fall into the sane category as a grandfather clause in other instances.Mr.Smith concurred. Discussion ensued regarding the sign ordinance compliance or application for variance.The Board felt that this siqn is unique.
