AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,
•'CONFIRMING,RATIFYING AND APPROVING A LEASE
AGREEMENT WITH RANGEL MANAGEMENT GROUP SOUTH,INC.,
D/B/A PAINTED BIRD CAFE RESTAURANT,FOR TWELVE (12)
NON-EXCLUSIVE PARKING SPACES WITH REGARD TO CERTAIN
DESCRIBED PROPERTY FOR A PERIOD OF FOUR (4)YEARS
WITH AN OPTION TO RENEW FOR AN ADDITIONAL FOUR (4)
YEARS FOR THESUMOF $2,400 YEARLY,PAYABLE IN ADVANCE,'
AND AUTHORIZING THECITY MANAGER TO ENTER INTO SAID
•LEASE AGREEMENT,COPY OF WHICH IS ATTACHED HERETOAND
MADE A PART HEREOF.
BEIT ORDAINED BYTHE MAYOR AND THECITY COMMISSION OFTHE.
CITY OFSOUTH MIAMI,FLORIDA:
Section 1.That the lease agreement with Rangel Management
Group South,Inc.,d/b/a Painted Bird Cafe Restaurant,for twelve parking spaces
located on the property located at S.W.71st Street and S.W.58th Avenue,South
Miami,Florida,be,and the same is hereby confirmed,ratified and approved.
Section 2.That the City Manager be,and is hereby authorized
to enter into said lease agrement for a period of four (4)years with an option
to renew for an additional (4)years for a sum of $2,400 yearly,payable in
advance,and authorizing the City Manager to enter into said lease agreement,
copy of which is attached hereto and made a part hereof.

LEASE AGREEMENT
THIS AGREEMENT,made this (2pL day of /fZ^f^/.1985,
between the CITY OF SOUTH MIAMI,a municipal corporation,party of
the first part,and RANGEL MANAGEMENT GROUP SOUTH,INC.d/b/a THE
PAINTED BIRD CAFE,partyofthe second part.
WITNESSETH
That the party of the first part has demised andleasedto
the party of the second part,the premises situated in the City of
South Miami,County of Dade,State of Florida,>known and described as
follows:
Twelve non-exclusive parking spaces,all
which shall be located within 500 feet
walking distance of 5811 Sunset Drive,S.
Miami,Florida.
saidusetobe effective only from 11:00 a.m.to11:00 p.m.daily,
and said property to be used only for off-street parking.The City
reserves the right to maintain parking meters for its own account or
its assigns upon said parking spaces.
To have and to hold the same,unto the party of the second
part,from the date of the execution of this Lease Agreement until
the 31st day of July,1989.And the party of the second part in
consideration of said demise,does covenant and agreewith the-party—

FIRST*;To pay to the party>f the first part at the office
of City Pinance Director as rent for said leased premises the sum of
Two'Thous^d"Fou^^^($2,400.00)per year,
payable yearly in advance in eq\ial yearly installments of $2,400.00
on the 30th day of September of eachand every year during the term
hereof except that the rent from the inception of this lease through
September 30,1985 is hereby acknowledged as received andthe

SECOND:That upon the termination of this lease,the second
party will yield upsaid premises tosaidparty ,of thefirst part in
the same condition and repair as received (lossby fire and ordinary
wear and tear excepted).
THIRD:Thatitwillnotsubletsaidpremises,noranypart
thereof,nor assign this lease without the prior written consent of
the party of the first part.
FOURTH:Renewals.This lease may be renewed by party of
the second partuponthesametermsand conditions forone
consecutive term to consist of four years.
FIFTH:All of the parties to this lease agree that the
covenants and agreements herein contained shallbebindingupon,
apply andinure to,their respective heirs,executors,administrators
and assigns.
SIXTH:This lease is contingent upon thepartyofthe
secondpartreceivingpermissionfromthepartyofthefirstpartto
operate a restaurant witha seating capacityof50at5811 Sunset
Drive,South.Miami,Florida.
