WITH AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA:

A vested participant who is not credited with at least one
hour of service for any plan year beginning after
December 31,1975 may elect,during the election period,to
have the ERISA survivor annuity rules apply if such
participant 1)had at least one hour of service duringthe
period commencing September2,1974 and ending with the last
day of theplanyear commencing in 1975,2)has not yet
reached his or her annuity starting date,and3)has
attained the later of the qualified early retirement age
under the plan or 120 months prior to the normal retirement
date.The election period referred toin the previous
sentence is the period beginning August23,1984 and ending
on the earlier of the participant's annuity starting date or
the participant's death.
The participant will not bear any part of the cost of
providing the preretirement survivor annuities described
above,and will bear the cost of any joint and survivor
annuity provided at the annuity starting date.
The survivor annuity benefits otherwise providedby this
amendment are subject to any qualified domestic relations
order,as defined by Internal Revenue Code section 414(p),
andsuch benefits shall be provided only to the extent that
provision of the benefit is consistent with the terms of the
order.
Section 2.This ordinance shall be in effect from and after
August 23,1984.
