AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,
GRANTING A VARIANCE TO EXXON TO ALLOW TWO (2)
DETACHED SIGNS OF 21.7 SQUARE FEET EACH WHERE NO
DETACHED SIGNS ARE PERMITTED AS TO CERTAIN DESCRIBED
PROPERTY LOCATED AT 6180 SUNSET DRIVE,SOUTHI MIAMI.
AND LEGALLY DESCRIBED AS:LOTS 12,13,14 AND THE
WEST 25 FEET OF LOT 15 OF REVISED PLAT OF POINCIANA
PARK,AS RECORDED IN PLAT BOOK 41 AT PAGE 41 OF THE
PUBLIC RECORDS OF DADE COUNTY,FLORIDA.,
WHEREAS,the Planning Board of the City of South Miami has
recommended denial of the variance herein requested;and
WHEREAS,Staff of the City of South Miami has recommended
denial of the variance herein requested;
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That a variance request by Exxon to allow two (2)
detached signs of 21.7 square feet each where no detached signs are permitted as
to certain to certain described property located at 6180 Sunset Drive,South Miami,
and legally described as:
Lots 12,13,14 and the West 25*of
Lot 15 of REVISED PLAT OF POINCIANA
PARK SUBDIVISION,as recorded in Plat
Book 41 at Page 41 of the Public Records
of Dade County,Florida.
be,and the same is hereby approved.
Section 2.This ordinance shall take effect immediately at the
thetimeofits passage.

Requests Variance to allow two detached signs of
21.7 square feet each where no detached signs
are allowed.

A discussion ensued among the Board members as the whether this same request
was reviewed by them last year.Diana Wheeler answered in the negative
stating that the applicant had previously appeared before the Board for a
detached identification sign.This request is for two detached price signs.
Mr*Jerry Crawford,engineer with the Exxon Corporation from Ft.Lauderdale,
addressed the Board and Mr.Ramon Perez introduced himself as the dealer
atthe station.Mr.Crawford described thelocationasbeingblockedfrom
view necessitating some type of recognition from the street that the
station was open and operating.He indicated that the dealer has experienced
a loss economically andmay loose his business asa result of lack of
recognition.He stated that improvements had been made to the station with
reference to appearance and landscaping.
Mr.Ramon Perez,station dealer,statedtotheBoardthenumberofgallons
hehadlostsincelastyearsincethesignswere removed.

Chairman Smith interrupted the meeting and announced he had a pressing
engagement to attend and would have bo excuse himself.He turned the
meeting overtothe Vice-chairman,Mr.Bernard Mlchelson.
Mr.Perez continued describing price competition intheareaand stated
that though he was 2to3 cents cheaper than surrounding stations,.his
volume was low because of lack of price advertising.He also stated
that his business lias not picked up since S.W 62nd Avenue;was widened to
four laneso
Mr„Chris Mann,sign contractor,stressed the appearance of the sign as
being low profile.
Since noone else wishing to speak came forth,Mr.Michelson declared the
Public Hearing closed.
Mr„Cbburn asked the applicant why flat signs that were approved had not
been installed.Mr.Crawford replied by saying that they wished to have
signs outnearthe street whichwouldbe more visible.

Dissension ensued.
The Board noted that should a sign of this type Ix?approved,there would
be a rush of similar requests and an uncVsircd precedent would be
established.

Staff recommends devial.
The applicant's service station business is an existing non-conforming
use in a CO zoning district.Unlike the Chevron station located diagon
ally across the street in a CI zone,regulations governing this property
do not permit free standing signs.
Although all the other service stations in South Miami each have a free
standing sign,these are identification and not price signs.In this City,
service stations uniformly post prices on their gasoline pumps.
