No. 12-85-1228ORDINANCE NO.12-85-1228 AN ORDINANCE OFTHE CITY OF SOUTH MIAMI,FLORIDA, AMENDING SECTION 7-1-1,SPACE REQUIREMENTS CHART OF ARTICLE VII,OFFSTREET PARKING REGULATIONS, OFSECTIONIOFORDINANCE NO.20-71-724,HERETOFORE ADOPTED ASTHE OFFICIAL ZONING ORDINANCE OF THE CITYOFSOUTH MIAMI,FLORIDA,BEADDINGPARKING REQUIREMENTS FOR MEDICAL AND CLINICAL USES ATA RATIO OF ONE (1)SPACE PER TWO HUNDRED TWENTY-FIVE SQUARE FEET (225 SQ.FT.)OF GROSS FLOOR AREA;AND REOUIRING A MINIMUM OF THREE (3)SPACES;REPEALING ALL ORDINANCES"IN CONFLICT AND PROVIDING AN EFFECTIVE DATE. WHEREAS,the Planning Board of the City of South Miami has recommended denial of the requested space requirements herein;and WHEREAS,Staff of the City of South Miami has recommended approval of the space requirement provision herein; NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OFTHECITYOFSOUTH MIAMI,FLORIDA: Section 1.That Section 7-1-1,Space Requirements Chart,of Article VII Off Street Parking regulations of Section 1.of Ordinance No.20-71-724, heretofore adopted as the Official Zoning Ordinance of the City of South Miami, Florida,be and the same is hereby amended,by adding parking requirements for Medical and Clinicial uses ata ratio of one (1)space per 225 sq.ft.of gross floor area;and requiring a minimum of three (3)spaces. Section 2.All ordinances or parts of ordinances in conflict herewith be,and the same are hereby repealed. Section 3.This ordinance shall take effect immediately at the time of its passage. Diana Wheeler explained thattherehas with parking for Medical Offices. >een «m ongoing problem Mr.Smith stated that he would liketo withdraw his Motion to approveand would,instead,liketomakeaMotionto deny. Mr.Coburn did not wish to retract his 'second'.Chairman Michelson,then,explained thatMr.Smith could voteinthe negative if he was against this item. Mrs.Wheelerreiteratedthe insufficiency ofparkingfor medical office buildings at one space for every two hundred and seventy- five square feet.She stressed the need for greater parking where this use occurs. Chairman Michelson spoke against the proposal noting that the City of South Miami presently has the strictest parking require ments ofany municipalityandhe further suggestedthat medical offices should require no more parkinq area than legal,account ing a,id insurance offices which alL require large staffs. Mrs.Wheeler stated that other types of offices may require more parking,but complaints concerning parking where almost exclusively limited to medical offices. Mr.Coburnsuggestedthat special parking requirements could not be enforced. VOTE ON MOTION MOTION FAILED Yes-0 No -5
