No. 07-85-1223ORDINANCE NO.7-85-1223 AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA, AMENDING A PORTION OF SUBSECTION 12-3-1,MEMBERSHIP, OF ARTICLE XII AS IT PERTAINS TO THE PLANNING BOARD OF SECTION 1.OF ORDINANCE NO.20-71-724,HEREFORE ADOPTED AS THE OFFICIAL ZONING ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,BY:DELETING EXCUSED ABSENCES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS,the Planning Board has considered,reviewed and recommended the amendments to the zoning ordinance herein requested; NOW,THEREFORE,BEITORDAINEDBYTHEMAYORANDTHECITY COMMISSIONOFTHECITYOFSOUTHMIAMI,FLORIDA: Section 1.That a portion (second paragraph)of subsection 12-3-1.MEMBERSHIP,of Article XII as it pertains to the Planning Board,of Section 1.,of Ordinance No.20-71-724,heretofore adopted as the Official Zoning Ordinance of the City of South Miami,Florida,be,and the same is hereby amended,to-wit: 12-3-1 Membershi p The Planning Board shall consist of seven (7)members, who shall be residents of the City of South Miami. Members shall be appointed by the Mayor with the advice and consent of the Commission.Four (4)members shall be appointed on March 1st of even numbered years and three (3)members shall be appointed on March 1st of odd numbered years.Terms shall be for a period of two (2) years. Notwithstanding the two(2)year appointment provided in Section 12-3-1 above,any regular member of the Planninq Board who misses three (3)regular meetings in arow or five (5)regular meetings inatwelve(12)month period will be automatically removed as amember of the Planning Board;providing for the appointment of the Director of Planning andZoning to keepapprop riate records of meetings missed andto advise the City Commission and the member being removed that such member hasbeen automatically removed. Section 2.All ordinances or parts of ordinances in conflict here with be,and the same are hereby repealed. Section 3.This ordinance shall take effect immediately at the time of its passage. Vice-Chairman Michelson opened the hearing for discussion and inquired whether this was presented atthe request ofthe Chairman.Diana Wheeler answered in the affirmative and preceded to explain that the Planning Board requested that the staff get together with the City Attorney to come up with a legal addition to our existing regulations.The City Attorney felt this is in keeping with the intent of the orginal motion that the Board made and it is also legal in the sense that all that is involved is scheduling in such a way as to maintain a quorum,not gauranteeing that there would be one.In practical terms,this means that there cannot be more than two members on vacation at the same time. Since there was no audience present to participate in the discussion, Vice-Chairman Michelson declared the Public Hearing closed. MOTICN:By Mr.Prentiss that the request be dropped. Seconded by Mr.Cooper. Mr.Michelson requested a change in the choice of words from ^dropped"to "denied"and called for another motion. Mr.Prentisswithdrewhis motion. MOT10*1:By Mr.Coburn to approve. Seconded by Mr.Perry. Discussion ensued. It was_stated that after a certain number of days absent,the Board no longer becomes efficient or effective as public servants and that con tinuity and consistency in attendance was of paramount iitiportance.
