AN ORDINANCE OF THE CITY OF SOUTH MIAMI,FLORIDA,
AMENDING SECTION 11-10(b)PAYMENT OF FEES BY ADDING
PROVISION THAT SUCH FEES SHALL BECOME DELINQUENT
IFNOTFULLYPAIDONORBEFOREDUEDATEAND
AMENDING SECTION 11-11 FEES SHALL CONSTITUTE LIENS

TAXES ALL'AS PERTAINING TOCITYOF SOUTH MIAMI CODE
OF ORDINANCES,CHAPTER 11,GARBAGE AND TRASH,AND
PROVIDING AN EFFECTIVE DATE.
BEIT ORDAINED BYTHEMAYORANDTHECITY COMMISSION OFTHE
CITYOFSOUTH MIAMI,FLORIDA:
Section 1.That Section 11-10(b)of Chapter 11,Garbage &
Trash ofthe Code of Ordinances be and the same is hereby amended by adding
provision that fees shall become delinquent if not fully paid onor before due
date,to-wit:
(b)Payment of Fees:The fees prescribed in Section 11-9 are due &
payable in advance semiannually on October 1st and
April 1st at the semiannual rate.Such fees shall become
delinquent if not fully paid on or before due date.
Section 2.That Section 11-11 ofChapter 11,Garbage &
Trash of the Code of Ordinance be and the same is hereby amended by changing
penalty fee to lh%per month on unpaid sanitation charges and adding provision
for enforcement to be the same as provided for City Ad Valorem taxes,to-wit:
11-11 Fees Shall Constitute Leins:
(a)For service of refuse collection and disposal by the City or
the availability of such service,all improved property shall
be liable forthe payment ofthe refuse collection fees.All
fees becoming due and payable shall constitute and are hereby
imposed as special assessment liens against the real property
aforesaid and,until fully paid and discharged or barred by
law,shall remain liens of equal rank and dignity with the
lien of the City Valorem taxes and superior in rank and
dignity to all other liens,encumbrances,titles and claims
in,to or against the real property involved.All delinquent
fees shall bear a penalty of one and one-half (1%)percent
per month from the due date until fully paid.Unpaid and
delinquent fees,together with all penalties imposed thereon,
shall remain and constitute special assessments against the
real property involved.Such special assessment liens may be,.
enforced as provided for enforcement of City Ad Valorem
taxes,or in the alternative,forclosure proceedings maybe
instituted and prosecuted under the provisions of Chapter 173,
Florida Statutes,or the enforcement of payment thereof may
be accomplished by any other method authorized by law.
Section 3.All ordinances or parts of ordinances in
conflict herewith be,and the same are hereby repealed.
Section 4.This ordinance shall take effect immediately
atthe time of its passage.
