AN ORDINANCE OF THE COMMISSION OF
THE CITY OF SOUTH MIAMI REPEALING
ORDINANCE NO 16-85-1233 AND PROVID
INGFOR REGISTRATION OF LOBBYISTS,
REPORTING REQUIREMENTS CERTAIN EX
EMPTIONS THERETO,FOR PENALTIES,
CODIFICATION,A SEVERABILITY CLAUSE
AND AN EFFECTIVE DATE
BE IT ORDAINED BY THE MAYOR AND COMMISSION OF THE CITY OF
SOUTH MIAMI,Dade County,Florida,as follows:
Section 1.This ordinance shall be known as the South Miami
Lobbyist Registration Ordinance.
Section 2.For the purposes of this ordinance the following
terms shall have the definitions contained herein:
(a)City Clerk is the official designated to accept
the registration and reports of lobbyists.
(b)Lobbyist is a person,firm or corporation who is
receiving compensation to influence passage of legislation or
administrative action before the Commission,Boards,
Committees or administration of the City of South Miami.
(c)Principal means the person,firm corporation or
other entity which has employed or retained a lobbyist.
Section 3.Any person who is receiving remuneration or
compensation for services as a lobbyist before engaging in activ
ities to influence passage of legislation or administrative
action in the City of South Miami shall register with City Clerk
on forms provided for such registration which shall state under
oath,their name,address and the name and business address of
each principal represented and the general and specific areas of
legislative interest.Separate registration is required for each
principal represented.The registration shall also state any
direct business association with any member of the City Commis
sion,Board,Committee or officer or employee of the City.
Section 4.A lobbyist shall submit once each year in which
such lobbyist has appeared before the City Commission or any
Board,Committee or officer or employee of the city for the
purpose of attempting to influence legislation or administrative
action a report of all monies expended in such efforts and the
purpose of such expenditure.Such forms shall be filed with the
City Cterk no later than January 15th,of the following year.
Section 5.The following persons will be exempt from the

provisions of this ordinance.
(a)Any person who merely appears before the Commis
sion,boards,committees or officers and employees of the
city for the purpose of self-representation while attempting
to influence legislation or administrative action without
receiving compensation or remuneration or in his or her
individual capacity wishes to express support or opposition
to pending legislation or administrative action shall not be
required to register or report as a lobbyist under this
ordinance.
(b)Any member of the Florida Bar who is representing
a client in a quasi-judicial or administrative proceeding
before the City or who is mandated by state law to represent
a client in such proceedings shall not be required to
register or report as a lobbyist under this ordinance.
(c)Any person appearing as an expert witness called
in proceedings before the Commission,any Board ora
Committee or the Administration of the City who presents
testimony in support of a position or explaining such
position.
Section 6.Any person who fails to comply with the
provisions of this ordinance and who is convicted of such
violation by a Court of competent jurisdiction shall be punished
for each such violation up to the maximum permitted by law.
Section 7.Any provision of any ordinance or regulation of
the City of South Miami which is in conflict with the provisions
of this ordinance shall be deemed to have been repealed by this
ordinance.That Ordinance No.16-85-1233 adopted on June 4,1985
be and is hereby repealed in its entirety.
Section 8.If any provision contained in this ordinance is
held invalid by a court of competent jurisdiction,such invalidi
ty shall not affect any rematntng portion of the ordinance/"
Section 9.It is the intention of the City Commission and
hereby ordained that the provisions of this ordinance be
incorporated into the code of the City of South Miami a part of
Chapter 2 of said code,and the word "ordinance"may be changed
to "section"or another appropriate word.
Section 10.This Ordinance shall become effective immedi
ately upon it adoption by the City Commission.
