ORDINANCE NO.13-87-1285 AN ORDINANCE OF THE MAYOR AND COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,AMENDING SECTION 13-2-1 OF ARTICLE XIII OF CHAPTER 20 OF THE CODE OF ORDINANCES BY PROVIDING FOR THE CITY COMMISSION TO ACT UPON REQUESTS FOR VARIANCES AND CONTINUATIONS OF NON-CONFORMING USES BY RESOLUTION;PROVIDING FOR PUBLIC HEARINGS ON SUCH REQUEST;PROVIDING FOR SEVERABILITY,PROVIDING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH BE REPEALED,AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,pursuant to Section 13-2-1 of Article XIII of Chapter 20 of the Code of Ordinances of the City,the Mayor and City Commission have established procedures regarding hearings on matters arising under the Zoning Code of the City;and WHEREAS,the Planning Board has recommended that the City Commission make the following amendments to the above described Section. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That Section 13-2-1 of Article XIII of Chapter 20of the Code of Ordinances is hereby deleted in its entirety and that the following shall be substituted in its place: 13-2-1 Hearings •Phe-€mmeii—sha-ii—hcl-d--pnbiit:—hearings -wh-err amettdimg-;changing—or sttpylemen Ling bhirs" Ga^in-anee;changing zoning drs-t-rrcrb bo-iarrteta-r-ire-s-;—gr-airbittg--va-r-irawo&s--arret-permitting •fcfre-—ct>irbiiTUS"kion—-orf—non-conforming—u sesr— The-se*—•ac-bi-orre sharH"—-be e-f-fecttrated-—by* ©r^iiTaTTcre*:*Go*ttTrcHL"i—sec biroir—on—"s>peci*cri crs"e"S";~ an-d —appea is—of—•acrmiTra,s,LT,airi""7e~tNjtjts'ttj i is,*"iiray be-—in the -foxitr—or'*"a""*R"3's,0flxrt-'i,crn and siraiti""not reqirrre—ptrbiic—hearings tnri"mys utliuiwrsre retjufir*ed*-by •thtse "Tregrrta Lions. 13-2-1 Hearings The Commission shall hold public hearings,to be noticed in the manner and form required by State Statute for the adoption of Ordinances, when amending,changing or supplementing Chapter 20 of the Code of Ordinances, changingzoningdistrictboundaries, re-zoning or changing permitted land use categories in a zoning district,granting or denying variance requests,permitting the continuation of non-conforming uses,requests for special uses,or any other matter upon which a recommendation is made by the Planning Board after public hearing by that body.Actions upon variances,continuations of non-conforming uses,and special uses shall beby resolution.All other actions shall be by Ordinance. Section 2.That ifany word,section or portion of this ordinance is held invalid by a court of competent jurisdiction,such invalidity shall not affect the remaining words,sections or portions of this ordinance. Section 3.That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4:Effective Date.This ordinance shall be effective October 1,1987.
