AN ORDINANCE OF THE CITY OF SOUTH MIAMI,
FLORIDA CREATING A LOCAL GOVERNMENT NEIGHBOR
HOOD IMPROVEMENT DISTRICT TO BE KNOWN AS THE
SOUTH MIAMI NEIGHBORHOOD IMPROVEMENT DISTRICT
WITHIN AN AREA CONTAINING APPROXIMATELY
1,552.4 ACRES BOUNDED ON THE SOUTH BY S.W.
88th STREET,ON THE WEST BY S.W.69th STREET,
ON THE NORTH BY S.W.40th STREET,AND ON THE
EAST BY S.W.57th AVENUE.
WHEREAS,the governing body ofa municipality may adopt an
ordinance authorizing the formation of Safe Neighborhood
Improvement District;and
WHEREAS,the Mayor and City Commission of the City of South
Miami,Florida,concomitant with this Ordinance wishes to
authorize the creation of Safe Neighborhood Improvement Districts
within the City of South Miami;and .
WHEREAS,the City's Department of Building,Zoning &
Community Development has recommended the creation ofa Local
Government Neighborhood Improvement District forCity.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.District Created
A Local Government Neighborhood Improvement
District is hereby created to include approxi
mately 1,552.4 acres inan area bounded on the
South by S.W.88th Street,on the West by S.W.
69th Avenue,on the North by S.W.40th Street,
and on the East by S.W.57th Avenue.
Section 2.Name of District
The Local Government Neighborhood Improvement
District created hereby shall be known as the
South Miami Neighborhood Improvement District.
Section 3.Authority to Apply for and Receive Grant
The Local Government Neighborhood Improvement
District created hereby is authorized to apply
for and receive from the Florida Department of
Community Affairs upto $30,000 for a planning
grant and uptoan additional $30,000 to employ
the services of technical experts.
Section 4.Utilization of Tax or Special Assessment
The purpose is hereby stated that the District
may utilize a maximum of two (2)mills ad
valorem taxes or special assessments on real
property within the City.These means of
financing will not be used by the City Com
mission.
Section 5.Designation of Board of Directors
The Mayor and City Commission are hereby
designated asthe Board of Directors of the
District.
Section 6.Establishment of Advisory Board
An Advisory Board is hereby established for the
Local Government Neighborhood Improvement Dis
trict created hereby.The Advisory Board shall
be composed of no fewer than five (5)members
who shall be owners of real property located in
the District or residents of the District.The
members of the Advisory Board shall be appointed
by the Board of Directors and serve at the
pleasure of the Board of Directors.The Advi
sory Board shall perform such duties as may be
prescribed by the Board of Directors and shall
submit,within the time period specified by the
Board of Directors,a report on the District's
proposed activities and a proposed budget to
accomplish the District's objectives.In formu
lating a plan for services or improvements,the
Advisory Board shall consult in public sessions
with the appropriate staff of consultants of the
City ofSouthMiami responsible for preparation
of the District's plan.
Section 7.If any clause,section,sentence orotherpart
of this Ordinance is held to be invalid or
unconstitutionalbyanycourtofcompetent
jurisdiction,the remainder of this Ordinance
shallnotbe affected thereby butshall remain
in full force and effect.
Section 8.Allordinancesorpartsofordinancesin
conflict herewith beandthe same are hereby
repealed.
Section 9.This Ordinance shall beinfullforceandeffect
immediately upon time of its passage.
