WHEREAS,pursuanttoResolution159-88-7070theMayorand
City Commission oftheCityofSouth Miami directedtheCity
Administration to comply withtheFloridaWasteManagement Act;and
WHEREAS,theMayorandCity Commission oftheCityofSouth
Miami,FloridadeemitinthepublicinteresttoamendChapter 11,
entitled"GarbageandTrash"oftheCodeofOrdinancesoftheCity
in order to begin compliance with said Act.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Section 11-4,of the Code of Ordinances
entitled Preparation of Refuse is hereby amended as follows:
11-4 Preparation of Refuse.
a)Domesticgarbageshallbedrainedand wrapped ina
newspaper,paperbagorplasticbagbefore depositing inthe

b)Domestic trash,otherthan grass,hedge clippings,
leaves,branchesandvinesshallbeplacedin containers or
bundled in lengths of four <4)feet or less and shall have a

f)Notwithstanding anything else contained in Chapter 11of
this Code of Ordinances.Aluminum and bimetal beverage cans.

glass food and beverage containers shall be segregated from all
other solid waste material by residential refuse customers.
Aluminum and bimetal beverage cans and glass food and beverage
containers shall be placed in household recycling containers,
originally provided by the City.These containers shall remain
the property of the City.and shall be replaced only upon
payment of the fee established by the City for such replacement.
"Aluminum and bimetal beverage cans"shall mean aluminum and
bimetal alcoholic and soft drink cans only.No other cans.
foil,or other metals shall be included."Glass,foods,and
beverage containers"shall mean whole glass ,1ars and bottles
designed to contain grocery items such as.but not limited to.
ketchup,mustard,pickle,and mayonnaise .jars,soft drink,beer,
wine.and liquor bottles and medicine bottles.Removal of
labels,caps or neck rings isnot required.Glass should be
reasonable free of food and beverage residue.No window glass,
mirror glass,or other glass shall be included.
Section 2.That Section 11-7 <g>ofthe City's Codeof Ordinances
is hereby amended as follows:

g)Penalty for Removal.It shall bea violation of this
Ordinanceforany person,firmor corporation not authorized bv
theCity Manager to collect or remove any newspaper or other
recyclable item or container which has been specifically placed
forcollectionintherecyclingprogramasprovidedbvthis
article.It isnotthe intent ofthissectionto prohibit anv
nonprofit organization from soliciting newspapers.can.or
bottles for the purpose of resource recovery and recycling.
Section 3.Itis intended that the provisions of this Ordinance
shall become and be made a part of the Code of Ordinances ofthe
City,and that the Sections of this Ordinance may be renumbered,
relettered and the word "Ordinance"may be changed to "Section",
"Article",or such word or phrase in order to accomplish such
intention.
Section 4.If any clause,section,or other part of this Ordinance
shall be held by any court of competent jurisdiction to be
unconstitutional or invalid,such unconstitutional or invalid part
shall be considered as eliminated and in no way effecting the
validity of the other provisions of this Ordinance.
Section 5.All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
rnSection6.ThisOrdinanceshallbecomeeffective ninety-days fro
its passage.
