An Ordinance repealingSection2-35oftheCity of South Miami's Code of
Ordinances.
WHEREAS,Section 2-35 was enacted in1953;and
WHEREAS,Section2-35requirespaymentto contractor's incash;and
WHEREAS,Section2-35 requires abidbondforprojectshavingavalueinexcessof $5,000
which isnota reasonable requirement in 2015;and
WHEREAS,Section2-35requiresadvertisementinstatewidenewspapersforallprojects
havingavalueinexcess of $5,000 whichisnotreasonableornecessarytoprotecttheinterestsofthe
City;and
WHEREAS,theCity Charter requiresthattheCitymust obtain 3bidsfrom different sources
of supplyforany project withavalueinexcess of $5,000;and
WHEREAS,most of the requirements of Section 2-35,that are reasonable,are more
appropriate for projects with estimated valuesinexcess of $200,000;and
WHEREAS,Florida StateSection255.0525 regulates the competitive requirements for
construction of municipal projects thathavean estimated valuein excess of $200,000;and
WHEREAS,Section 2-35placesan unnecessary burdenand expense ontheCityandlocal
construction contractors.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.Section2-35 of theCityofSouthMiamiCode of Ordinancesisherebyrepealed
and Section 2-35 is reserved as follows:
Sec.2-35.-Reserved.Publication of notice for sealed bids:date,content:bid bond or
certifiedcheck;contractbond;mannerofpaymentforwork.
Assoonaspracticableafterthe confirmation ofanysuchresolutionorderingworktobe
constructed,thecitymanagershallpublishatleast once,inanewspaperofgeneral
circulation inthe city,andifthe estimated cost exceeds five thousand dollars,ina newspaper
of general circulation throughout the state,a notice calling for sealed bidstobe received by
thecity council onadatenot earlier than fifteen days from thefirst publication inthe local
paper,orifsaid estimate exceeds five thousand dollars ineachofsaidtwo newspapers,for
the construction ofthework,unlessinsuch resolution thecitycouncil Commission shall
havedeclareditsintentiontohavetheworkdonebycityforceswithout contract.Thenotice
mayreferin general terms tothe extent and nature ofthe improvement or improvements and
may identify the same bytheshort designation indicated inthe initial resolution andby
reference tothe plans and specifications on file.Ifthe initial resolution shall have given two
ormorealternativedescriptionsoftheimprovementastoitsmaterial,nature,characterand
size,and ifthe city council shall not have heretofore determined upon a definite description,
the notice maycallforbidsuponeachof such descriptions.

No contractor shallbe required totake bonds,warrants,or certificates in payment,but
payment shall be made in cash upon monthly estimates ofthe superintendent of public works
totheamountofninetypercentofsuch estimates,andthe balance dueshallbepaidincash
withinsixtydaysafter acceptance oftheworkbythecity,andthenoticemaystatesuch
conditionsastopayment.Bidsmayberequestedfortheworkasawholeorforanypart
thereof separately,andbidsmaybe asked foranyoneormore improvements authorized by
thesameor different resolutions,butanybid covering workuponmorethanone
improvement shallbeinsuchformastopermita separation ofcostastoeach improvement.
Thenoticeshallrequirebidderstofilewiththeirbidseitheracertifiedcheckuponan
incorporatedbankortrustcompanyfortwoandonehalfpercentoftheamountoftheir
respectivebidsorabidbondinlikeamountwithcorporatesuretysatisfactorytothecity
attorneytoinsuretheexecutionofacontracttocarryouttheworkinaccordancewithsuch
plansandspecificationsandtoinsurethefiling,atthemaking of suchcontract,of abondin
theamount of the contract pricewithsuretiessatisfactorytothecitymanager,conditionedfor
theperformance of theworkinaccordancewithsuchcontract.Thecitycouncilshallhavethe
righttorejectanyandallbids,and if allbidsarerejected,thecitycouncilmayreadvertiseor
may determine todo the work bycityforces without contract.

Section 2.Codification.The significant provisions of this ordinance shall become andbe
made part of the Code of Ordinances of theCity of South Miami as amended;that the sections of this
ordinance maybe renumbered or re-lettered to accomplish such intention;and that theword
"ordinance"maybe changed to"section"orother appropriate word.
Section 3.Ordinances in Conflict.All ordinances or parts of ordinances andall sections
andparts of sections of ordinances indirect conflict herewith areherebyrepealed.
Section 4.Severability.If anysection,clause,sentence,orphrase of this ordinance isfor
anyreasonheld invalid or unconstitutional byacourt of competent jurisdiction,this holding shallnot
affectthevalidity of the remaining portions of thisordinance.
Section 5.Effective Date.Thisordinanceshallbecomeeffectiveuponenactment.
