WHEREAS,Habitat for Humanity of Greater Miami,Inc.has made application for a variance from Section 20-3.5 (E)of the Land Development Code to allow a sixteen (16)foot front setback where a twenty-five (25)foot setback is required and a seven feet eight inches (7'8'')rear setback where twenty-five (25) foot setback is required on property located in the RS-4 Single- Family Residential zoning district;and, WHEREAS,the property is located at 6560 S.W.59 Avenue; South Miami,Florida,33143,and is legally described as follows: The South 25.86 of Lots 116 and 117 "University Park", recorded in Plat Book 18,page 46,of the Public Records of Dade County,Florida;together with the east 11.25 feet of that certain alley laying west and adjacent to the property,as closed per Ordinance 7- 79-1029 of the Public records of Miami-Dade County, Florida,less the South 112.78 feet thereof;and, WHEREAS,Planning Division staff recommended approval of the application fora variance upon evaluating the application for (a)consistency with the Comprehensive Plan and (b) compliance with the hardship requirement contained in Section 20-5.9 (C)of the Land Development Code;and, WHEREAS,on November 30,1999,the Planning Board voted 5:0 to recommend approval of the variance;and, WHEREAS,the Mayor and City Commission of the City of South Miami desireto accept the recommendation ofthe Planning Board. Section 2.This approval is subject to and dependent upon construction of the proposed single-family residential house in conformity with the layout depicted in the submitted site plan. Section 3.The City Manager may revoke this approval upon a determination that the provisions of this resolution have been violated or any violation is occurring at the subject property or related property that is not in compliance with this resolution. Section 4.The City Manager shall have final approval and authority over all matters regarding the determination of the applicant's compliance with the intent of these sections. Ms.Chimelis read the request intothe record. Staff reported that the item was being carried over fromthe Board's last meeting and included changes reflecting commentsrelatedinthatmeeting. Staff noted that such changes included(1)the incorporation of a seven-year amortization scheduleand(2)in matters involvingmajor building facade renovation,the grandfathering of a sign would bevoided. Staff explained that (1)theitem,asrevised,is beyond that which had been originally advertisedand that (2)theCityAttorney advised thattherequestbe deferred atthistime. Staffexplainedthat,inresponsetothe Board's comments expressed atthatmeeting, specificpercentageshadbeenaddedtothelanguageinvolving Mixed-Use Standards(E) for office and retail projects. Staff notedthat,in regard toresidential projects (E)(1),languagewould remain as stated withouta specific percentage. Public hearing was opened. Therebeingno one present wishingtospeakfororagainsttheitem,the public hearing was closed. The Board and staff discussed language contained inthe Comprehensive Plan,which defined mixed use. Staff explained that the Plan language could not bechanged;however,theLDC section could be amended to clarify the City's mixed-use objective. Suggestions for clarification included that uses be bolded (line20)and that language in each project be added (line 31). TheBoardand staff discussed language,included intheproposed ordinance. Suggestions included toaddlanguage ...in orderto ensure a mix ofuses,thecity requires that,for eachdevelopment...forIntent(A). Theboard directed staff toprovidethepreciselanguage.
