A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,RELATING TO
EMERGENCY MANAGEMENT;DECLARING A WEATHER
EMERGENCY PURSUANT TO SECTIONS 14.05 AND 14.12 OF
ORDINANCE NO.11-93-1539;DIRECTING THE CITY
MANAGER TO EXERCISE ALL NECESSARY AND
APPROPRIATE POWERS TO PREPARE FOR AND RESPOND
TO HURRICANE FLOYD;PROVIDING AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS,pursuanttoitsmunicipalhomerulepowerstopreparefor,and
respondto,weatherandother emergencies theMayorandCityCommission of the
City of SouthMiamienactedOrdinanceno.11-93-1539,entitled"Emergency
Management";and,
WHEREAS,theEmergencyManagementordinanceprovidesforthecity
manager orhis,orher,designee,torecommenda declaration of aweather
emergency pursuant tosections14.05and14.12,andupondeclaration of an
emergency,providesforthecitymanager,orhis,orher,designeetoexercise
powersrelatingtoevacuation;curfewanddesignation of restrictedareas;
suspensionorregulation of thesale of alcoholicbeverages,ammunition,firearms,
explosivesandcombustibles;prohibitiononpricegouging;wateruserestrictions;
suspension of localbuildingregulations;regulation of theuseandrationing of
fuel,iceand other essentialgoods;andemergency procurement procedures;and,
WHEREAS,HurricaneFloydonSeptember13,1999wasclassifiedasa
categoryIVhurricaneandthestormisprojectedbytheNationalHurricaneCenter
tomakelandfallinorneartheCity of SouthMiamionTuesdaySeptember14,
1999.A recent hurricane trackingchartandsatellite photograph areannexedto
this resolution.
WHEREAS,the Mayor andCityCommission believe itis necessary to
declareaweatheremergencyandtoorganizeallavailableCityresourcesto
preparefor,respondtoandrecoverfromallthreatstothesecurity,safetyand
health of theCity of SouthMiami.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA;
Underscoredwords constitute the amendment proposed.Overstruckwordsaredeleted.Remaining
provisionsarenowineffectandremain unchanged.
Section 1.A weather emergency resulting fromthe threat of imminent
damagefrom Hurricane Floydis declared toexistas of thisdate.
Section 2.TheCity Manager is authorized and directed to exercise all
necessaryandappropriatepowersunderOrdinanceno.11-93-1539toaccomplish
emergency management duringtheduration of thisemergency.TheCityManager
shallreporttothecommissionatitsnextregularlyscheduledmeeting,unlessa
specialmeetingiscalledearlier,apreliminaryassessment of thedamagecaused
bythehurricane,allactionstakeninresponsetotheemergency,theeffectiveness
of the emergency managementstructure,theestimatedcost of theresponse,
furtheractionswhichmayberequired,contractswhichmustbereviewedand
ratifiedbythecommissionandanyemergencybudgetappropriationswhichmay
be requested.
Section3.TheCityManagerisauthorizedtoprocuresuppliesand
equipment requiredfortheCitytoprepareforandrespondtotheemergency
situation created by Hurricane Floyd.
Section 4.This declaration of emergency shallbe effective immediately
and remain in effect forfifteendaysuntil September 28,1999;oruntilthenext
meeting of the commission,whichisnow scheduled for September 21,1999
unlessitis terminated earlier bythe commission orby certification of theCity
Manager orhis designee.
Section 5.This resolution shalltake effect immediately upon approval.

Sec.14.09PoliceEmergencies.
(A)A public emergency may be declared because of civil unrest
or imminent threat to public peace or order when the Chief of
lu «e,',0r if ^available,the next highest ranking officer in
the Police Department chain of command,certifies to the City
Manager that an emergency condition arising from hostile actions
of others,armed or unarmed or other imminent threat to public
peace or order,requires extraordinary measures for control,
including,but not limited to curfew;blockade;proscription of
the sale of firearms and other weapons,alcohol beverages;
explosives and combustibles;evacuation;and other like actions.
The City Manager shall report said certification to the officials
in the order named in Section 14.05 regarding the need to declare
a state of emergency.Pursuant to Section 14.05,a declaration
of emergency maythenissue.
(B)Declaration of a public emergency because of civil unrest or
imminent threat to public peace or order,shall authorize the
issuance of emergency resolutions A,B,C,D and H,and other
appropriate resolutions,as may be required and may,if
applicable,require automatic emergency measures pursuant to
Florida Statutes Section 870.044 et seo.In addition,additional
aiSCS!cionarv emergency measures pursuant to Florida Statutes
870.045 may be issued.
(C)A public emergency may be declared because of fire and
hazardous materials emergencies,utility emergencies,and weather
