WHEREAS,theMayorandCity Commission of the City of SouthMiami byResolutionNo.62-95-9610 initiated boundary change procedures toSection 20-3,Metropolitan-Dade CountyCodeandsubmitteda proposal forthe annexation of fourareas,designatedas areas A,B,C,andD.;and WHEREAS,theapplicationwasconsidered by theMiami-DadeCounty Boundaries Commission,which approvedtheannexation of only area "B"of the proposal;and WHEREAS,Miami-DadeCountyElectionsdepartmentheldanelectionon this issue whereby residents in the area of Northern Boundary;SW 72nd Street (SunsetDrive;Eastern Boundary;CityLimits of theCity of SouthMiami, Southern Boundary;SR 878 (Snapper Creek Expressway)and SW 80th Street and Western Boundary;SR826(PalmettoExpressway)wereaskedwhetherornot those areas shouldbeannexedtotheCity of SouthMiami;and, WHEREAS,theMiami-DadeCountyCanvassingBoard publicly canvass the votes cast in the election on the issue of whether or not the annexation of certainlandstotheCity of SouthMiamishallbe approved;and WHEREAS,the votes castatthat election was153 votes againstand30 votes for annexation;and WHEREAS,theMayorandCity Commission desiretocompensateMiami- Dade County Board of County Commissioners for conducting thiselection. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA; Additions shownbyunderlininganddeletionsshownby ovorstriking. Section 1.That the City Manager is hereby authorized to disburse from Account No.001-2100-519-9950 the sum of $5,894.40 to Miami-Dade Board of County Commissioners forthe conduct of an annexation election. WHEREAS,the City of South Miami has been contacted by residents in areas adjacent to the city who have expressed an interest in annexing their communities into the city;and, WHEREAS,the City of South Miami commission directed the city managertoevaluatethe feasibility ofannexingcertain communities into the city;and, WHEREAS,thecity manager presented theCityofSouth Miami Annexation Information report,dated March 21,1995 to the city commission which identified and provided a preliminary annexation feasibility evaluation of eight communities (designated as areas A through H);and, WHEREAS,the City of South Miami commission,at its regular commission meeting onMarch 21,1995,selectedthe communities designatedasareasAthroughDforfurtherevaluationanddirected the city manager to give notice to all property owners within the areas,and within 600 feet of the boundaries of the areas, according to the current tax assessment role,of a public workshop on April 13,1995 and a public hearing on April 18,1995 ona resolution to initiate one or more boundary changes;and, WHEREAS,a notice of hearing ona resolution toinitiateone or more boundary changes was mailed to all property owners within the areas identified as areas A through D,and within 600 feet of the boundaries of the areas,according to the current tax assessment role,in accordance with Section 20-3,Metropolitan-Dade County Code,and notice was further published in Miami Herald on April 8,1995. WHEREAS,maps identifying the areas designated as A through D, the notice,proof of mailing the notice,and proof of publication of the notice are annexed and made a part of this resolution as composite Exhibit 1;and, WHEREAS,the City of South Miami commission conducted a public workshop on April 13,1995 and a public hearing on April 18,1995; and, WHEREAS,after considering all of the responses from residents ofthe city and from non-residents who live inthe areas identified as A through D,and the reports of the city manager,the City of South Miami commission determines thatit is inthe best interests of its residents and the residents in the areas identified in paragraph 2 of this resolution to initiate a boundary change. Jl£^i^J«|U NOW,THEREFORE,BEIT RESOLVED BY THE MAYOR AND CITY COMMISSION OFTHE CITY OFSOUTHMIAMI,FLORIDA: Section 1.The Whereas clauses are true,correct,and they are incorporated andmadeapartofthisresolution. Section 2.TheCity Commission oftheCityof South Miami requests the County Commission of Metropolitan-Dade County to change the city's boundaries andto annex the areas described in the maps of areas A through D into the City of South Miami, pursuant tothe procedures in Section 20-1,et sea.ofthe Metropolitan-Dade County Code. Section 3.The City Commission of the City of South Miami specifically requests the Clerk of the County Commission,upon receipt of the City of South Miami's request for boundary change, to place the matter on the agenda of the next ensuing regular meeting of the county commission and to notify the city manager of the date on which the matter will be considered by the county commission. Section 4.The city manager shall prepare the request for boundary change in accordance with Section 20-3 and 20-4 of the Metropolitan-Dade County Code and file the application with the Clerk of the County Commission forthwith. Section 5.The city manager shall be the city's administrative representative in proceedings before the county commission,the County Planning Advisory Board and in communications with the county manager and other county officials. Section 6.The City Commission of the City of South Miami requests the Metropolitan-Dade County Commission,inthe event it exercises the power under Section 20-9(a)of the Metropolitan-Dade County Code to call an election within the area proposed to be annexed,tocallfor separate elections ineachof xthe areas described inthemapsasarea A,B,C,and D.
