RESOLUTION NO.160-99-10784 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO PUBLIC SAFETY;DIRECTING THE CITY MANAGER TO PUBLISH INFORMATION ON CHANNEL 5 CABLE TELEVISION REGARDING THE PRESENCE OF SEXUAL PREDATORS RESIDING IN THE CITY;PROVIDING AN EFFECTIVE DATE. WHEREAS,theMayorandCityCommission of theCity of SouthMiami arechargedwiththe responsibility of providing forthepublicsafety;and, WHEREAS,theFlorida Legislature foundthatsexualpredatorspresenta highlevelthreattothepublicsafetyand directed law enforcement agencies to informthepublic of the presence of sexual predators inthe community;and, WHEREAS,theMayorandCity Commission has determined that publication of information on Channel 5cable television regarding the identity and residence of sexualoffendersisanefficientwaytoinformthepublic. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITYOFSOUTHMIAMI,FLORIDA; Section 1.ThePolice Chief shallprovidetheCityManagerwiththe following information regarding sexual predators livinginthecity,asprovidedby the Florida Department of Law Enforcement: 1.The name of thesexual predator; 2.Adescription of thesexualpredator,includingaphotograph; 3.Thesexual predator's currentaddressinthecity; 4.The circumstances of thesexual predator's offense(s);and 5.Whether the victim of the sexual predator's offense(s)was,at the time of the offense,a minor or adult. ThePolice Chief shallnotdisclose,if known,theidentity of the victim.ThePolice Chief shallinformtheCity Manager whena sexual predator isremovedfromthe state's sexual predator list. Section 2.The City Manager shall publish the prescribed infonnation aboutthesexual predator onChannel5cabletelevision.TheCityManagershall also provide sexual predator infonnation onthe city's website,whenthesiteis established. applicable bv morethan3 years. (b)Any offense based upon misconduct in office byapublicofficeroremployeeatanytimewhenthe defendant is in public office or employment,within 2 years from the time he or she leaves public office or employment,or during any time permitted by any other part of this section,whichever time is greater. (4)An offense is committed either when every ele ment has occurred or,if a legislative purpose to prohibit a continuing course of conduct plainly appears,atthe time whenthe course of conduct orthe defendant's complicity therein is terminated.Time starts to run on thedayafter the offense is committed. <5)(a)Prosecution ona charge on which the defendant has previously been arrested or served with a summons is commenced bythe filing ofan indict ment,information,or other charging document. (b)A prosecution ona charge on which thedefend anthasnot previously beenarrestedorserved with a summonsis commenced when eitheranindictmentor information is filed,provided the capias,summons,or otherprocessissuedonsuch Indictment or information is executed without unreasonable delay.In determining what is reasonable,inability to locate the defendant after diligent search orthe defendants absence from the state shall be considered.The failure toexecute processonorextraditea defendant inanother state who hasbeen charged by information or indictment with a crime inthisstate shall not constitute an unrea sonabledelay. (c)If,however,an Indictment or information has been filed within thetime period prescribed inthissec tion andthe indictment orinfonnation ie dismissedor setasidebecauseofadefectinits content or form after the time period has elapsed,the period for commenc ing prosecution shall beextended3months from the time the indictment or information isdismissedorset aside. (6)The period of limitation does not run during any time when the defendant ie continuously absent from the state or has no reasonably ascertainable place of abode orwork within thestate.This provision shall not extend the period of limitation otherwise applicable by more than3 years,butshallnotbeconstruedto limit the prosecution of a defendant who has been timely charged byindictment or information or other charging documentandwhohasnot been arrestedduetohisor herabsence from thisstateorhasnot been extradited for prosecutionfrom another state. N**—$••tomw u.932.05,032.08.916.03,838.486. 77&21 The Florida Sexual Predators Act;defini tions;legislative findings,purpose,and intent; criteria;designation;registration;community and public notification;immunity;penalties,— (1)SHORT TITLE.—This section may be cited as The Florida SexualPredatorsAct," (2)DEFINITIONS.—As used in this section,the term; (a)"Chief of police"meansthechief law enforce ment officer ofa municipality. (b)"Community"means any county where thesex ual predator lives or otherwise establishes ormaintains atemporaryor permanent residence. (c)"Conviction"means a determination of guilt which is the result ofatrial or the entry of a plea of guilty or nolo contendere,regardless ofwhether adjudication is withheld.A conviction for a similar offense includes, but Is not limited to,a conviction bya federal or military tribunal,including courts-martial conducted bythe Armed Forces ofthe United States,andincludes acon viction inanystateofthe United States. (d)"Department"meansthe Department of Law Enforcement. (e)"Entering the county"Includes being discharged from a correctional facility or jail or secure treatment facility within the county or being under supervision within thecounty for the commission ofa violation enu merated insubsection (4). (0 "Permanent residence"means a place where the person abides,lodges,or resides for 14 or more consecutivedays. (g)Temporary residence"means a place where the person abides,lodges,or resides for a period of 14 ormore days inthe aggregate during any calendar year and which is not the person's permanent address;for a person whosepermanentresidenceisnotinthisstate, a place where the person is employed,practices a vocation,or is enrolled asa student for any period of time in this state;or a place where the person routinely abides,lodges,orresides for a period of4ormore con secutive or nonconsecutrve days in any month and which Is nottheperson's permanent residence. (3)LEGISLATIVE FINDINGS AND PURPOSE; LEGISLATIVE INTENT.- 2317 \a}nepeai sexual onenaers,sexual onenaers wno use physical violence,and sexual offenders who prey on children are sexual predators who present an extreme threattothe public safety.Sexual offenders are extremely likely touse physical violence andto repeattheiroffenses,andmostsexual offenders com mit many offenses,havemanymore victims thanare ever reported,andare prosecuted for only a fraction of their crimes.This makesthecost of sexual offender vic timization to society at large,while incalculable,clearly exorbitant. (b)The high level of threat that a sexual predator presents tothe public safety,andthe long-term effects suffered by victims ofsex offenses,provide thestate with sufficient justification to Implement a strategy that includes: 1.Incarcerating sexual predators and maintaining adequate facilities to ensure thatdecisionstorelease sexual predators into the community arenotmadeon thebasisof inadequate space. 2.Providing for specialized supervision of sexual predators who are in the community by specially trainedprobationofficers with low caseloads,as described in ss.947.1405(7)and 948.03(5).The sex ualpredatorissubjecttospecifiedtermsand conditions implemented atsentencingoratthe time ofrelease from incarceration,with a requirement thatthose who are financially able must pay all orpart of thecosts of supervision. 3.Requiring the registration of sexual predators, with a requirement that complete andaccurate informa tion be maintained and accessible lor use by law enforcement authorities,communities,and the public. "'4.Providing for community and public notification concerning thepresence of sexual predators. 5.Prohibiting sexual predators from working with children,eitherforcompensationorasa volunteer. (c)The state has a compelling interest in protecting the public from sexual predators and in protecting chil dren from predatory sexual activity,and there is suffi cient justification for requiring sexual predators to regis terandfor requiring community and public notification ofthe presence ofsexualpredators. (d)It isthe purpose of the Legislature that,upon the court's written finding that an offender is a sexual pred ator,in order to protect the public,it is necessary that the sexual predator be registered with the department and that members of the community and the public be notified of the sexual predator's presence.The desig nation ofapersonasasexualpredatorisneithera sen^ tence nor a punishment but simply a status resulting from the conviction of certain crimes. (e)ItistheintentoftheLegislatureto address the problem ofsexual predators by: 1.Requiring sexualpredatorssupervisedinthe community tohavespecial conditions of supervision andtobe supervised byprobation officers with low caseloads; 2.Requiring sexualpredatorsto register with the Florida Department of Law Enforcement,as provided in this section;and 3.Requiring community and public notification of the presence ofa sexual predator,as provided in this section. (4)SEXUALPREDATOR CRITERIA.- (a)Foracurrentoffensecommittedonorafter October1,1993,andbeforeOctober 1,1995: 1.An offender who was found bythe court under former s.775.22 or former s.775.23tobeasexual predator isa "sexual predator"if thecourt made a writ ten finding thatthe offender wasa sexual predator at the time of sentencing,as required by former s.775.23. Suchsexual predator must register orbe registered as asexualpredator with the department as provided in subsection (6).andis subject to community and public notification as provided in subsection (7).Upon,notifi cation ofthepresenceofasexual predator,the sheriff of the county orthe chief of police ofthe municipality wherethesexualpredator establishes ormaintainsa permanent or temporary residenceshall notify mem bersofthe community andthe public ofthe presence ofthesexual predator in a manner deemed appropriate bythe sheriff orthe chief of police. 2.if an offender has been registered asa sexual predator bythe Department of Corrections,the depart ment,oranyother law enforcement agency and: a.Thecourtdidnot,for whateverreason,makea written finding atthe time ofsentencingthatthe offenderwasasexual predator,or b.The offender was administratively registered as asexualpredatorbecausethe Department of Correc tions,the department,oranyother law enforcement agency obtained information whichindicatedthatthe offendermetthesexual predator criteria basedona violation ofa similar law inanother jurisdiction, the department shallremovethatoffenderfromthe department's sexual predator list,and shall notify the state attorney who prosecuted the offense that trig geredthe administrative sexual predator designation for offenders described in sub-subparagraph a.,or the state attorney ofthecountywheretheoffenderestab lishesor maintains a permanent or temporary resi dence on October 1,1996,foroffendersdescribedin sub-subparagraphb.Thestate attorney may bring the matter to the court's attention In order to establish that theoffendermeetsthesexualpredator criteria.:If the courtthen makes a written finding thattheoffenderis asexualpredator,the offender isdesignatedasasex ualpredator,must register orbe registered asa sexual predator with the department as provided in subsection (8),andIssubjectto community and public notmcation requirementsas provided insubsection (7).If the court doesnotmakea written finding thatthe offender isa sexualpredator,the offender isnotdesignatedasa sexual predator with respect to that offense,isnot requiredtoregisterorberegisteredasasexualpreda torwith the department,andisnot subject tothe requirementsfor community and public notification as a sexual predator.
