A Resolution authorizing the City Manager to execute a contract with
BM General Repairs LLC for the installation of a new roof at the Public
Works office building.
The existing roof is experiencing damage due to numerous leaks. The
useful life of the roof has been exceeded and is deteriorating daily. The
roof leaks have also caused interior damage due to water intrusion.
Not to exceed $13,000 (includes a 10% contingency.)
301.1790.519.6450 (Capital Improvements) has a balance of $212,794.

12 WHEREAS, It was determined that BM General Repairs LLC submitted a bid in the amount of
13 $11,800 that was the most responsive and cost effective; and

15 WHEREAS, the City desires to provide a 10% contingency over the proposal amount of $11,800
16 for unknown factors that may arise during the work in an amount not to exceed $13,OOO;and

18 WHEREAS, the expenditure be charged to departmental Capital Improvements account number
19 301.1790.519.6450.

21 NOW, THEREFORE, BE IT RESOLVED THE MAYOR AND CITY COMMISSION OF THE CITY OF
22 SOUTH MIAMI, FLORIDA:

24 Section 1. The City Manager is authorized negotiate and execute a contract with BM General
25 Repairs LLC, for the installation of a new roof at Public Works office building, for an amount not to exceed
26 $11,800 and the Manager is authorized to expend an additional $1,200 for any unforeseen conditions
27 and circumstances, all of which is to be charged to account number 301.1790.519.6450 with a current
28 balance of $212,794.

30 Section 2. Severability. If any section, clause, sentence, or phrase of this resolution is for any
31 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
32 the validity of the remaining portions of this resolution.

ARTICLE II: INCLUSIONS
The fo!iowing items are included in this agreement:
• Secure a roofmg pennit.
• Furnish and supervise all labor, materials, and equipment needed to perfonn the scope of
work outlined above.
• (5) year warranty on labor will be provided by BM GENERAL REPAIRS LLC
• All work perfonned on behalf ofthe project, not to exceed the scope of work as stated in
this contract, and under nonnal wear and tear circumstances. The warranty excludes
extraordinary events such as hurricane damage, fire, or vandalism.
ARTICLE III: EXCLUSIONS
The following items are not included in this agreement:
• All Truss, and Ceiling
• All items not included in the scope of work outlined above
• All interior / exterior demolitions not outlined in the scope of work
• All painting
• All extra work and materials that require a change orders beyond the standard pricing
• No Construction
• No Surveys
• Existing illegal or non-approved (no fonnal City pennit and/or update) construction
• No Architectural Drawings
• Fees that should be paid to applicable governmental institutions
• Fees for tests required to obtain City approvals

ARTICLE VI: CHANGE ORDERS
All change orders must be in writing and sigoed by all the parties. The Owner agrees that changes
resulting io the furnishing of additional labor or materials will be paid for prior to the
commencement of any extra work. The Owner agrees that either of them may sigo a change order,
and that sigoature will be binding on both.
ARTICLE VII: REOUIRED TIME
Upon approval of our proposal by the Owner, the above stated scope of work for the Project will
be completed withio reasonable time, of our receipt of First payment.
Please note that Governmental approval times vary and are not within BM GENERAL REPAIRS
LLC control, therefore they are considered outside the scope of work.
ARTICLE VIII: PROPOSAL SUBMISSION:
This proposal has been prepared specifically to suit the specifications and requirements of your
project.
Ifwe can be of any further services, or if you have any questions regarding this bid, please do not
hesitate to contact us for a meeting, to discuss any matter.
ARTICLE IX: ACCEPTANCE OF PROPOSAL:
This document will serve as our initial proposal, upon your acceptance it will become our
Agreement (Contract).
If the above price, specifications, scope of work, and conditions are to your satisfaction and are
hereby accepted. Please sigo and date below and we will proceed with your project immediately.

Contract Acceptance
We, the undersigned, have read and understood this entire contract, including documents attached
by reference, if applicable. We acknowledge that this document constitutes the entire agreement
between the parties, and therefore we approved.
