WHEREAS,itis estimated thatthe budget for non-retainer legal services willbe exceeded by $36,902;and, WHEREAS,itis essential to provide sufficient funds forlegal services through theend of the fiscal year;and, WHEREAS,the Mayor andCity Commission desire to transfer sufficient funds from surplus cash carry over to account no.1500-514-3410,Legal Services-Non Retainer. Discussion:This has been an active year for the city commission and tor the city attorney's office,fhis fiscal year,total retainer time to date is 165%ofretainer payments,resulting in write-offs by die law firm of $26,859.Last year total retainer time was 204%ofthe retainer payments.Asa result,we wrotc-orT $78,007. For your information,the total city attorney's budget for FY 1998-99 is $139,250, which is a small reduction from the prior budget of $144,650.The city attorney's budget for the Village of Pineerest is $180,000 and for the Village of Key Biscayne is $213,000.1 believe that those two municipalities engage in much less legal activity than the City of South Miami. A copy of the retainer agreement,budget,Finance Department account balance and city attorney budget for the Village of Key Biscayne is attached.
