A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO BUDGET;
AUTHORIZING A TRANSFER OF $36,902 FROM SURPLUSS CASH
CARRY OVER TO ACCOUNT NO.1500-514-3410,LEGAL
SERVICES-NON RETAINER;PROVIDING AN EFFECTIVE DATE.
WHEREAS,itis estimated thatthe budget for non-retainer legal services willbe
exceeded by $36,902;and,
WHEREAS,itis essential to provide sufficient funds forlegal services through
theend of the fiscal year;and,
WHEREAS,the Mayor andCity Commission desire to transfer sufficient funds
from surplus cash carry over to account no.1500-514-3410,Legal Services-Non
Retainer.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA;
Section 1.The Mayor andCity Commission approves the transfer of $36,902
fromsurpluscashcarryovertoaccountno.1500-514-3410,LegalServices-Non
Retainer.
Section 2.Thisresolutionshalltakeeffectimmediatelyuponapproval.

Legal Services-Non Retainer,to cover unfunded liability and estimated future costs.
Discussion:This has been an active year for the city commission and tor the city attorney's
office,fhis fiscal year,total retainer time to date is 165%ofretainer payments,resulting in
write-offs by die law firm of $26,859.Last year total retainer time was 204%ofthe retainer
payments.Asa result,we wrotc-orT $78,007.
Concerning current non-retainer charges for litigation and special projects,we
estimate that charges will exceed the budget by approximately $36,902,calculated as
follows:

The shortfall is largely attributable to the SPG parking garage project.To date,the
cost of the project is $32,944.We roughly estimate that future costs to complete contract
negotiations to September 30,will range from $12,000 to $17,000.
For your information,the total city attorney's budget for FY 1998-99 is $139,250,
which is a small reduction from the prior budget of $144,650.The city attorney's budget for
the Village of Pineerest is $180,000 and for the Village of Key Biscayne is $213,000.1
believe that those two municipalities engage in much less legal activity than the City of
South Miami.
A copy of the retainer agreement,budget,Finance Department account balance and
city attorney budget for the Village of Key Biscayne is attached.
Recommendation:Approve the resolution transferring $36,902 from account no.
toaccountno.1500-514-3410,Legal Services-Non Retainer.The transfer will be part ofthe
budget adjustment which will take place next month.
