RESOLUTION NO.107-99-10731 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OFTHECITYOFSOUTHMIAMI,FLORIDA,RELATINGTO PROPERTY;RELEASING AN INTEREST IN CERTAIN REAL PROPERTY;PROVIDING AN EFFECTIVE DATE. WHEREAS,theCityof South Miami anda predecessor intitletoreal property,legally described as: Lot2lesstheW.10feet of theS.80feet,andall of Lot3,COOPER'S SUBDIVISION,accordingtothe PlatthereofrecordedinPlatBook,4,Page 152,Public Records of DadeCounty,Florida entered into an agreement in 1969 under which the property owner,Robert's Thirteen,Inc.,for itself and all successors and assigns,agreed to remove improvements "on the north 30 feet"of the property if needed by the city for widening Sunset Drive orthe sidewalk,and waived any claim for damages;and, WHEREAS,the agreement isrecordedln official records book 6749,at page 114 andencumbersthetitletotheproperty;and, WHEREAS,theagreementisambiguousasthenorth30feet of the property isnot contiguous with the right-of-way for Sunset Drive,and the city doesnothaveany foreseeable needforthe property;and, WHEREAS,theMayorandCity Commission desireto release anyinterest itmayhaveinthe encumbered property underthe agreement. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONOFTHECITYOFSOUTHMIAMI,FLORIDA; Section1.TheCityof South Miami releases anyinterestitmayhavein theencumberedproperty,legally described above,underthe agreement entered intobetweentheCity of SouthMiamiand Robert's Thirteen,Inc.,dated November1,1969,andrecordedinofficialrecordsbook6749,atpage 114. Section2.Thisresolutionmayberecordedinthepublicrecords of Miami-Dade County. Additions shown by underlininganddeletions shown byoverstriking. Mr.Subrata Basu was requested to review the matter and advised that he is not aware ofany interest thecitymay have inthe property. I have two serious problems from the title standpoint: -•-n 11 Tue existence of this Agreement,severely clouds thetitletotheselotsregardlessofwherethe30ft.portion is located;and * 2.The "North 30 feet"makes no sense as the designated area ^or removal of improvements because it would have been the South 30 feet which would have been adjacent to Sunset Drive instead of the North 30 feet which is in the middle of the propertybetweenSunsetDriveand U.S.l Earl G.Gallop,Esq. April 1,1999" Page 2 Earl,hopefullyyouaregoingtobeabletotellmethatthis recorded instrument isan anachronism for which thereisno further useor purpose andyou will be able to let meknowan appropriate procedure to have it released or terminated.Perhaps the City has records which show that it already has been terminated,but these records donotshowupinthe recent title searcheswhichhavebeen performed.
