A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI,FLORIDA,RELATING TOATTORNEY'S FEES;
APPROVING ATTORNEY'S FEES FOR STEVEN CARLYLE CRONIG &
ASSOCIATES P.A.INTHE AMOUNT OF$1,695,CHARGING THE AMOUNT
TO ACCOUNT NO.1500-3435,CONSULTING-REAL PROPERTY/
FORECLOSURE;PROVIDING AN EFFECTIVE DATE.
WHEREAS,theCityofSouth Miami commenced alien foreclosure proceedingagainst
propertylocatedat6576,6578and6580 S.W.60th Avenue,knownasthe"Marshall Williamson
Property";and,
WHEREAS,determining theowners,lessees,heirsandpersonsholding security interests
inthepropertyisnecessaryinordertoforeclosetheirinterestsandsecuretitleinfavor of thecity,
andthetaskhas been a complicated anddaunting;and,
WHEREAS,theCityAttorneyretainedthelegalservices of StevenCarlyleCronig&
Associates,P.A.toperformatitlesearchtoidentifyallpartieshavinganinterestintheproperty;
and,
WHEREAS,thelegalworkwas performed tothe satisfaction of theCity Attorney and
payment of the attached invoice is recommended.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.The invoices for attorneys'feesand costs received from Steven Carlyle
Cronig &Associates,P.A.,inthe amount of $1,695.00,is approved and payment shallbe charged
to Account No.1500-3435,Consulting-Real Property/Foreclosure.
Section 2.This resolution shall take effect immediately upon approval.

Subject:Thecity commenced a foreclosure action to recover $649,083.88 or title to the
property.The title to the property is encumbered by a 99-year lease,mortgages,tax liens,
potential judgment liens and other interests.Some of the title owners died intestate,which
required a search for potential heirs.Although a title search was performed several years
ago,1 believed it was necessary to perform a second search,in light of information we
discovered inthe intervening time and the potential for additional liens to have beencreated
against the property,in order to assure ourselves that all parties holding an interest in the
property have been identified and are brought within the jurisdiction of the court.The city
needs to acquire good title to the property,regardless whether it sells the property to recover
its lien amount,to use the property for a public purpose,orto convey the property toa not-
for-profit organization for use for a public purpose.
The legal title work was performed ina satisfactory manner,and the charge is
reasonable.
Recommendation:Approve the resolution for payment of title attorney's fees.
Thebalanceinthe account willbe $§.145 afterthis
expenditure.
