No. 25-97-1646ORDINANCE NO.25-97-1646 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE PERSONNEL SYSTEM,AMENDING CHAPTER 16-A (a)OF THE CODE OF ORDINANCES;PROVIDING FOR SEVERABILITY; ORDINANCES IN CONFLICT AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,theCity Commission shallestablishacivilservicesystemorameritsystemcoveringand embracingthesalaried employees oftheCityofSoutliMiami,exceptwhereinconflictwithanyotherprovisionof theCity of Soutli Miami Charter,and WHEREAS,theCity Manager hasthedutytoappointandwhennecessaryforthegoodoftheCity removeany non-elective officers or employees of theCity (excepting those authorized tobe appointed andremoved bytheCityCommission),providing suchremovaldoesnotconflictwithCivilserviceprovisions,and NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1:Section 16A-3(a)is amended to read as follows: (a)Exemptservice.The exempt service shall include thefollowing: (1)All elected officials and members of boards,committees and commissions. (2)TheCity Manager,all assistant city managers,andall administrative assistants andsecretariestothe forgoing.Department director,deputydirectors,assistantdirectors,divisiondirectors,agency heads, program directors andall immediate assistants andall secretaries tothe foregoing and commission appointees. (3)Volunteer personnel and personnel appointed toservice without pay. (4)Consultants and counsel rendering temporary profession service. (5)Suchposition involving seasonalorpart-timeemployment,orwhichconsistsofunskilledwork,as maybe specifically placed inthe exempt service bythe personnel rules. (6)Employees ofthepolice department withtherankofpolice commander.Lieutenant.Captain.Major or Deputy Chief of Police. When this chapter becomes effective,all persons then hold ing positions included inthe classified service: (1)Shall have permanent statusifthey had such status priortothe passage ofthis chapter;or (2)Shall continue to serve their probationary period ifit was in effectat the time of passage ofthis chapter. The class in which each employee shall have status shall be determined in the manner provided in Article 5,Sec.1 [sec tion 16A-11 of this Code].
