A ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO COMPENSATION
FOR COMMISSIONERS AND MAYOR;AMENDING ARTICLE 1,
SECTION 2-3 OF THE CODE OF ORDINANCES;PROVIDING FOR
SEVERABILITY;ORDINANCES IN CONFLICT AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS,Section 2-3 of the City's Code of Ordinances titled
"Compensation for commissioners and mayor-Established"provides
for monthly compensation of services by mayor and commissioners.
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1;Section 2-3 of the Code of Ordinances
entitled "Compensation for Commissioners and Mayor-Established is
hereby amended as follows:
There shall be paid to the mayor and to each commissioner of
the city such sums as are approved by the annual budget the sum
of twelve hundred dollars—($1,200)per year,—payable monthly as
compensation for services and as allowable expenses.as-
Commissioner.
There—shall—be paid to the mayor—&€—fehe—city—the—sum of
twelve—hundred—dollars—($1,200)—pea?—year,—payable—monthly—as
compensation for hi3 or her services to the city.
There—shall—also—fee—paid—fey—the—city—fee—the—mayor—and
commissioners,an additional sum to cover any and all expenses of
the office of mayor and commissioners,supported only by expense
vouchers—properly—explained,—signed—and—certified—when—under
twenty five—dollars—($25.00).Others—shall—fee—supported—by
proper vendor receipts.Cuch additional—sums—shall—be payable
monthly.5he—amounts—payable—§er—expenses—3hall—net—exceed the
amount appropriated for such purpose as established in the city
budget.
Section 2.If any section,clause,sentence,or phrase
of this ordinance isforany reason held invalid or
unconstitutional bya court of competent jurisdiction,the
holding shall not affect the validity of this remaining portions
of this ordinance.
Section 3.All ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby
repealed.

Section 4.This ordinance shall take effect immediately
at the time of its passage.

8 WHEREAS,the City Commission shall establish a civil service system ora merit system covering and
9 embracing the salaried employees ofthe City of South Miami,except where in conflict with any other provision of
10 theCity of South Miami Charter,and
11 WHEREAS,the City Manager hasthe duty to appoint and when necessary forthe good ofthe City
12 remove any non-elective officers or employees ofthe City (excepting those authorized tobe appointed and removed
13 bythe City Commission),providing such removal does not conflict with Civil service provisions,and
14
15 NOWTHEREFOREBEITORDAINEDBYTHEMAYORANDCITY COMMISSION OFTHECITY

22(2)TheCity Manager,allassistantcity managers,andall administrative assistantsand secretaries tothe
23 forgoing.Department director,deputy directors,assistant directors,division directors,agency heads,
24 program directors andall immediate assistants andall secretaries tothe foregoing and commission
25 appointees.
26 (3)Volunteerpersonnelandpersonnelappointedtoservicewithoutpay.
27 (4)Consultantsandcounselrenderingtemporaryprofessionservice.
28 (5)Suchpositioninvolvingseasonalorpart-time employment,orwhichconsistsofunskilledwork,as
29 maybespecificallyplacedintheexemptservicebythepersonnelrules.
30(6)Employees ofthepolicedepartmentwiththerankofpolice commander,Lieutenant,Captain,Major
31 or Deputy Chief of Police.

33 Section2.Ifanysection,clause,sentenceorphraseofthisordinanceisforanyreasonheldinvalidor
