No. 18-97-1639ORDINANCE NO.18-97-1639 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO AN AMENDMENT OF THE LAND DEVELOPMENT CODE IN ORDER TO INCLUDE ANGLED PARKING UNDER SECTION 20-7.26 ENTITLED STREET STANDARDS; CREATING A NEW SUB-SECTION (C)UNDER 20-7.26;PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT; AND,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,on March 18,1997,theCity Commission adopted Resolution No.56-97-10027,instructing Administration to prepare amendments to the Hometown District Overlay Ordinance,in order to permit angled parking on public streets in the district;and, WHEREAS,Administrationhaspreparedsuchamendmentsin orderto permit angled parking on public rights-of-way inthe HometownDistrictbyresolutionoftheCityCommission;and, WHEREAS,theCity Commission finds thatitisinthepublic interest to permit angled parking within the Hometown district; NOW,THEREFORE,BEIT ORDAINED BYTHEMAYORANDCITYCOMMISSIONOF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.A new sub-section 20-7.6(C)is hereby created to read as follows: (C)Angled parking and other parkingconfigurations maybe permitted on any right-of-way within the Hometown District by the affirmativevoteoffourCityCommissionersona resolution which approves such configurations.The City Commission may request a formalrecommendationbytheHometownDistrictParking Committee; however,saidrecommendationshallnotberequiredforactionnor shall such recommendation be binding upon the City Commission. Section 2.Ifany section,clause,sentence,or phrase of thisordinanceisforanyreasonheldinvalidor unconstitutional bya court of competent jurisdiction,the holding shall not affect thevalidityofthe remaining portionsofthis ordinance. OnMay 13,1997,the Planning Board voted7:0torecommend approval of the ordinance with an amendment tothe language of Section1(C),secondsentence,of the proposed ordinance to readas TheCityCommissionmayrequesta formal recommendationbytheHometownDistrict Parking Committee andthe Planning Board shall reviewsuchan application and forwardits Undines to the City Commission for consideration.... Staff recommends thatany street standards review bythe Planning Board be optional andonly bytheCity Commission's request,asopposedtoamandatorypart of theprocess.Theprimary purpose of thisordinanceistoprovideforincreasedparkingspacesalongS.W.73Streetviathe provision of angledparking.Staff believesthatitis imperative to provide increased parking for thedowntownmerchants before ground-breaking of theSunset Drive Improvements Project.A requirementforreviewbythe Planning Boardwilldelay implementation of the angled parking projectbyatleasttwomonths,andthiswillbetothe merchants'detriment.
